بررسي نقش نظارتي ديوان عدالت اداري بر رعايت حقوق ملت در پرتو آيات قرآن

Investigating the supervisory role of the Court of Administrative Justice on considering the rights of the nation in the Quranic verses

در تنظيم مناسبات دولت- شهروند نمي‌توان برآوردن حقوق افراد را به حسن نيت حكومت محول نمود و دسترسي به دادرسي اداري را بايد همچون ابزاري براي دستيابي شهروندان به ديگر حقوق خود در نظر گرفت. در نتيجه، علاوه بر محاكم قضايي كه به اختلافات بين مردم رسيدگي مي‌كنند، بايد محاكم اداري بي طرف و مستقلي وجود داشته باشند كه افراد در صورت نقض حقوقشان از سوي ارگان‌هاي دولتي و مجريان قانون بتوانند به منظور احقاق حق خود به آنجا مراجعه كنند كه از جمله اين محاكم، ديوان عدالت اداري است و اينكه ديوان عدالت اداري چه نقشي در نظارت بر رعايت حقوق ملت دارد؟ به عنوان مسأله‌اي قابل طرح است. در اين پژوهش كه به روش توصيفي-تحليلي صورت گرفته اين نتيجه قابل بيان است كه؛ ديوان عدالت در نقش حامي و مدافع حقوق ملت، اقدامات و تصميمات مأمورين و نيز مصوبات واحدهاي دولتي را زير نظر مي‌گيرد، به عنوان مرجعي قضايي به صورت غير مستقيم در تحقق حقوق ملت با نظارت بر محاكم اداري انجام وظيفه مي‌نمايد.

In regulating government-citizen relations, the fulfillment of individual rights cannot be entrusted to the goodwill of the government, and access to administrative proceedings should be considered as a means for citizens to achieve their other rights. As a result, in addition to the courts that deal with disputes between people, there should be impartial and independent administrative courts where individuals can go to law enforcement agencies to obtain their rights if their rights are violated by government agencies and law enforcement. Among these courts is the Court of Administrative Justice and what is the role of the Court of Administrative Justice in monitoring the observance of the rights of the nation? It can be raised as an issue. In this descriptive-analytical study, it can be stated that; The Court of Justice, in its role of advocate and defender of the rights of the nation, monitors the actions and decisions of officials as well as the approvals of government units, and acts as a judicial authority indirectly in the realization of the rights of nation under the supervision of administrative courts.
