تحليل علت شناختي ارتكاب جرايم مبتني بر نفرت با اشاره به رويكرد قرآن كريم

Causal analysis of hate crimes based on the approach of the Holy Quran

جرايمي كه با انگيزه تبعيض، تعصب و عدم پذيرش نسبت به گروه‌هاي خاصي به دليل ويژگي‌هاي هويتي مانند نژاد، قوميت، مليت، مذهب، جنسيت، گرايش جنسي، عقيده و از اين قبيل در جامعه ارتكاب مي‌يابند به عنوان جرايم مبتني بر نفرت توصيف مي‌شوند. در آيات مختلف قرآن كريم نيز اين جرايم منع شده‌اند و در آيات مختلفي رعايت اصل كرامت انساني توصيه گرديده است از جمله آيه 70 سوره اسراء كه خداوند متعال مي‌فرمايد: ﴿وَلَقَدْ كَرَّمْنَا بَنِي آدَمَ﴾ يعني و به تحقيق فرزندان آدم را گرامي داشتيم. اما عده­اي هم مانند گروه­هاي تكفيري داعش با سوء برداشت از برخي آيات شريف مرتكب فجيع­ترين جنايت انساني گرديده ­اند. حال آنكه ارتكاب چنين جناياتي به شدت مورد نكوهش قرآن كريم و مخالف روح متعالي كلام خداوند است. علت ارتكاب اين جرايم را از ديدگاه‌هاي مختلف جرم‌شناختي مي‌توان تحليل كرد. اين مقاله با روش تحليلي-توصيفي و به شيوه مراجعه به كتابخانه و فيش برداري و نيز ترجمه اسناد بين‌المللي و كتب داخلي به اين موضوع مي­ پردازد.

Crimes committed with the motive of discrimination, prejudice and non-acceptance towards certain groups due to identity characteristics such as race, ethnicity, nationality, religion, gender, sexual orientation, belief, etc. in society are described as hate crimes. These crimes are also forbidden in different verses of the Holy Qur'an, and in different verses, it is recommended to observe the principle of human dignity, including verse 70 of Surah Isra', in which God Almighty says:
﴿وَلَقَدْ كَرَّمْنَا بَنِي آدَمَ﴾ But some, like the takfiri groups of ISIL, have committed the most heinous crimes against humanity by misunderstanding some noble verses. However, committing such crimes is strongly condemned by the Holy Quran and it is against the transcendent spirit of God's word. The reason for committing these crimes can be analyzed from different criminological perspectives. This article investigates this issue by analytical-descriptive method and by referring to the library and taking notes as well as translating international documents and domestic books.
