دامنه اعمال قاعده «ضرورت » بر مقررات جهاد در فقه اسلامي

يكي از قواعد مهمي كه در اكثر ابواب فقهي مورد استفاده قرار مي گيرد «قاعده ضرورت» مي باشد. طبق اين قاعده ارتكاب فعل حرام و ممنوع با رعايت برخي شرايط از جمله «رعايت تناسب» مجاز مي باشد. از اين رو با اين كه حمله به اهداف غيرنظامي در حالت عادي از منظر مقررات اسلامي مجاز نيست اما با تحقق ضرورت نظامي حمله در چارچوب رعايت شرايط مقرر براي ارتكاب فعل ضروري مجاز مي شود. اما با اين وجود تحقق ضرورت نظامي در زمان جنگ نمي تواند دليلي براي استفاده از تسليحات كشتارجمعي باشد. لذا براي حفظ حكومت اسلامي يا اساس اسلام نمي توان از تسليحات كشتارجمعي استفاده نمود. زيرا اين امر نقض غرض از وجود اسلام و تشكيل حكومت اسلامي خواهد بود. علاوه بر اين كه امروزه باعنايت به پراكندگي كشورهاي اسلامي و مسلمان ها در اقصي نقاط جهان، عملا نابودي اساس اسلام ميسر نمي باشد. در نتيجه ضرورت حفظ «بيضة الاسلام» هرگز امكان تحقق نخواهد يافت. تا ضرورت استفاده از تسليحات كشتارجمعي مهيا شود.

One of the important rules that is used in most jurisprudential chapters is the "rule of necessity. According to this rule, committing a haram and forbidden act is permitted under certain conditions, such as “observing proportionality”. Therefore, although attacking civilian targets is not normally allowed from the perspective of Islamic law, but with the realization of military necessity, attack is allowed within the framework of the prescribed conditions for committing a necessary act. Nevertheless, the realization of military necessity in time of war cannot be a reason for the use of weapons of mass destruction. Therefore, weapons of mass destruction cannot be used to maintain Islamic rule or the basis of Islam. Because this would be a violation of the purpose of the existence of Islam and the formation of an Islamic government. In addition, today, due to the dispersion of Islamic countries and Muslims in all parts of the world, the destruction of the basis of Islam is practically impossible. As a result, the need to preserve the "Bayzat al-Islam" will never be possible, so that the use of weapons of mass destruction will be necessary.
