زمينه ها و هدف: قاعده تحذير يك قاعده فقهي است، به روايت از امام صادق (ع) كه مي فرمايند:« «قد اعذر من حذّر» يعني هركس هشدار بدهد معذور است. اين امر در اعمال نيروهاي مسلح قابل توجه مي باشد زيرا هر حكومتي براى حفظ استقلال، امنيت و تماميت ارضى خود نياز به نيروى مسلح است اما بكارگيري تجهيزات نظامي در برقراري اين نظم و امنيت شايسته چارچوي و مقرراتي است كه عدم رعايت آن منجر به مسئوليت كيفري مي گردد. در اين ميان اين سوال مطرح است كه قاعده تحذير چگونه مي تواند در رفع مسئوليت نيروهاي مسلح در قانون ايران و لبنان موثر باشد؟روش شناسي: اين مقاله به روش تحليلي- توصيفي نگارش يافته است. يافته ها: اين قاعده در حوزه مسئوليت مدني و مسئوليت كيفري اعمال مي گردد و در حال حاضر در حقوق بين الملل و حقوق ايران برخي كشورهاي خارجي از جمله لبنان در حوزه هاي مختلف پذيرفته شده است. نتيجه گيري: اين قاعده در حقوق جزاي عمومي از علل يا عوامل موجهه جرم و مشمول عنوان «حكم قانون و امر آمر قانوني» مي باشد ولي قانونگذار ايران و لبنان به مسئوليت نيروهاي مسلح ذيل مبحث قاعده تحذير و چگونگي رفع مسئوليت ناشي از آن نپرداخته است.
