Globalization of Crime and the Need for New Policy Making by Police in the Fight against Transnational Crimes

زمينه و هدف: نظريه جهاني شدن حقوق كيفري در سطح جهاني و بالتبع ايران نظريه جديدي است كه چالش هاي آن مورد بررسي قرار نگرفته است. از طرفي مطالعه ماهيت و جنبه هاي جرم شناختي جرايم جهاني نياز به جهاني فكر كردن پليس و رويكرد تحقيقاتيِ فراملي دارد، چنان كه پليس كشورهاي مختلف، نياز به كسب اطلاعات و آمار جنايي جوامع يكديگر و همكاري در اين زمينه دارند. لذا بايستي يافته هاي جرم شناسي به كمك عدالت كيفري بين المللي براي مقابله آگاهانه با جرايم جهاني يعني تعريف راهبرد مبتني بر مطالعات جرم شناختي مرتكبان و بزه ديدگان جرايم فراملي بشتابد. اين پژوهش با هدف، "سياست گذاري جديد پليس در زمينه مبارزه با جرايم فراملي " انجام شده است. روش شناسي: باتوجّه به ماهيّت موضوع، پژوهش حاضر از نظرگردآوري اطلاعات به روش اسنادي و از طريق مطالعه قوانين داخل، اسناد بين المللي و منابع معتبر انجام شده و اطلاعات به دست آمده به صورت توصيفي- تحليلي مورد تجزيه وتحليل قرار گرفته است. يافته هاي پژوهش: با توجه به جهاني شدن جرايم و چالش هاي آينده، معماري انساني، ساختار سازماني، برنامه ريزي، سياست گذاري و فرهنگ حاكم بر سازمان پليس بايد به گونه اي طراحي و اجرا شوند كه كاركنان پليس را به طور مستمر به سوي كاربرد عملي مبارزه با جرايم فراملي هدايت كند. نتيجه گيري: آنچه مي تواند از تهديدهاي ناشي از جرايم جهاني بكاهد، تدوين سياست هاي پليسي مناسب، تقويت ابزارهاي مبارزه با اين گونه جرايم، انعقاد قرارداد منطقه اي و بين المللي جهت همكاري هاي پليسي است.

Background and Aim: The theory of globalization of criminal law in the world and consequently in Iran is a new theory whose challenges have not been studied. On the other hand, the study of the nature and criminological aspects of global crimes requires global thinking being run by police and transnational investigative approach, as the police of different countries need to obtain information and criminal statistics from each other's communities and cooperate in this field. Therefore, criminological findings should be accelerated with the help of international criminal justice to consciously deal with global crimes, i.e. the definition of a strategy based on the criminological studies of perpetrators and victims of transnational crimes. This study has been done with the purpose "new policy making by police in the fight against transnational crimes." Methodology: Due to the nature of the subject, the present study has been done in terms of collecting information based upon the documentary method and by studying domestic laws, international documents and validated sources and the obtained information has been analyzed descriptively-analytically. Findings: Due to the globalization of crimes and future challenges, staff architecture, organizational structure, planning, policy-making and culture of the police organization should be designed and implemented in a way that guide police officers constantly to the applied practice of the fight against transnational crime.
