تحول در ماهيت مسئوليت مدني ناشي از حوادث رانندگي در نظام حقوقي ايران با نگاهي به نقش پليس راهنمايي و رانندگي

Changes in the nature of civil liability resulting from traffic accidents in the Iranian legal system with a look at the role of traffic police

مسئوليت مدني تعهد قانوني شخص بر رفع ضرري كه به ديگري وارد كرده است خواه اين ضرر ناشي از تقصير خود وي باشد يا ناشي از فعاليت او شده باشد. بر اين مبنا در هر موردي كه شخص ناگزير از جبران خسارت ديگري باشد، در برابر او مسئوليت مدني دارد. با توجه به استفاده روزافزون از تومبيل شاهد بروز حوادث رانندگي و ورود خسارت از اين منظر هستيم. مبنا و اركان مسئوليت مدني در تصادفات چيست؟ و پليس راهنمايي و رانندگي در اين خصوص از چه جايگاهي برخوردار است؟ روش تحقيق: اين مقاله به شيوه تحليلي- توصيفي نگارش يافته است. يافته ها: در نظام حقوقي ايران مباني متعددي موجب شكل گيري مسئوليت مدني مي گردد كه از آن جمله مي توان به تقصير ، خطر و تضمين حق اشاره نمود. همچنين در بررسي ابعاد حقوقي مسئوليت مدني ناشي از حوادث رانندگي در قانون ايران اركان شكل گيري اين مسئوليت كه شامل وجود خسارت، وقوع تصادف و رابطه سببيت اشاره نمود. در خصوص تحولات در قانون مسئوليت مدني ناشي از حوادث رانندگي بايد به دو مورد در قانون بيمه اشاره نمود يكي تعهد به بيمه يا تعهد به جبران خسارت در قانون جديد و ديگر مبناء مسوليت دارنده وسيله نقليه . نتايج: در تجولات مسئوليت مدني نقش پليس راهنمايي و رانندگي از دو جنبه داراي اهميت است. نخست هنگامي كه پليس به عنوان كارشناس در صحنه تصادفات حاضر مي گردد، دوم نقش پليس در مديريت صحنه تصادف از مي تواند بروز آسيبهاي ديگر پيشگيري به عمل مي آورد.

In the Iranian legal system, several principles lead to the formation of civil liability, including fault, danger and guarantee of rights. Also, in examining the legal aspects of civil liability resulting from traffic accidents in Iranian law, he mentioned the elements of the formation of this liability, which include the existence of damages, the occurrence of an accident and the causal relationship. Regarding the changes in the law of civil liability due to traffic accidents, two cases should be mentioned in the insurance law, one is the obligation to the insurance or the obligation to compensate the damages in the new law and the other is the basis of the liability of the vehicle owner. In the manifestations of civil liability, the role of the traffic police is important from two aspects. First, when the police are present as experts in the accident scene, and second, the role of the police in managing the accident scene can prevent other injuries.
