بعد از تتبع در آثار شهيدان صدر و مطهري، معلوم شد زماني كه صحبت از نقش زمان و مكان در اجتهاد به ميان مي آيد، مراد، خود زمان و مكان نيست؛ چون خود زمان و مكان، تاثيري در حكم شرعي ندارند و تغيير آنها باعث تغيير حكم شرعي نمي شود؛ بلكه مراد، اوضاع و احوالي است كه در زمان يا مكان، پديد آمده است و حكم و موضوع حكم شرعي را متعين مي سازد و تغيير آن، باعث تغيير حكم و موضوع حكم شرعي مي گردد. لذا اگر زمان و مكان، مطرح مي شود، براي اشاره به اوضاع و احوالي است كه در آن زمان و مكان قرار دارد و زمان و مكان، بستر وجودي آنهاست. از نظر شهيدان صدر و مطهري، دو عنصر زمان و مكان، نقش مهمي در حل مسايل نوظهور، ايفا مي كنند و دين مبين اسلام، با بها دادن به اين دو عنصر و با مطرح ساختن برخي اصول ديگر، كيفيتي در ساختار احكام خويش پديد آورده است كه همراه با تحولات اعصار گوناگون پيش برود و نيازها و مسايل هر عصري را با در نظر گرفتن اوضاع و شرايط حاكم بر همان عصر، پاسخ گو باشد و در تمام فروعات فقه، جاري و ساري شود.

Which goes hand in hand with the developments of various ages and responds to the needs and issues of any age, taking into account the circumstances and conditions prevailing in that same age, and to be heard and discussed in all jurisprudence.
