Epistemological Foundations in Western Law from the Beginning of Philosophy to Kant

موضوع معرفت شناسي، و يا نظريه دانش، ذهن انسان را براي هزاران سال به خود مشغول كرده است. موارد بسياري در مورد آن نوشته شده است، و راه هاي بسياري براي مطالعه آن وجود دارد. ميتوان گفت كه اين مساله به عنوان يك مقوله فلسفي در غرب، توسط افلاطون آغاز شده و بعدها توسط ارسطو، شاگرد افلاطون، بعدها بوسيله ديگر فيلسوفان عصر روشنگري همچون هابز، دكارت، الك، هيوم و در ادامه تاريخ تفكر غرب توسط كانت، توسعه يافته است. اين پژوهش دامنه دار فلسفي هيچ يك از جنبه هاي دانش بشري را از حيطه ي خود خارج ندانسته و با طرح مسايل بنيادين خود در هر شاخه از دانش بشري تاش كرده است تا با ضابطه هايي كه ارايه شده است ميزان صدق و باور پذيري دستاورد هاي آن دانش را مشخص نمايد . در دانش حقوق مسايلي از اين دست كه: پايه هاي اصلي دانش حقوق كدامند؟ از جمله مهم ترين اين سولات است. البته اين سوال را مي توان به گونه اي عام تر نيز طرح نمود: چگونه مي توان با دستيابي به درك معرفت شناختي فهم درستي از نظريات حقوقي داشت؟ در اين مفهوم، معرفت شناسي به دنبال شناسايي اصولي براي ارزيابي نظريه هاي حقوقي است. اين پژوهش بر آن است كه دريك نگرش تاريخي- فلسفي در زمينه تيوري حقوقي تاثير انگاره هاي معرفت شناسانه را در قطعه ي مهمي از تاريخ تفكر بشري دوران نضج گيري فلسفه در يونان تا ظهور كانت بررسي نمايد.

The issue of epistemology or theory of knowledge has preoccupied human mind for thousands of years. Numerous works have been authored regarding it and there are several ways for studying it. One can state that this issue, as a philosophical category, has begun by Plato in the west and later by Plato’s pupil Aristotle and many contributions have been made to it by the philosophers of the Age of Enlightenment like Hobbes, Descartes, Locke, Hume and in the history of western thought, it has been developed by Kant. This extensive philosophical study has not left any aspects of human knowledge outside itself and by raising fundamental issues in each branch of human knowledge, it has sought to determine the scale of truth of the achievements of this knowledge by the means of the provided measures. In the science of law questions, the following are among the most important questions: what are the basic foundations of law? This question can be raised in a more general way: How can we reach a correct understanding of legal theories via an epistemological conception? Thus conceived, epistemology seeks after identification of principles for evaluation of legal theories. The current study was an effort for studying the the influence of epistemological notions in an important part of the history of human thinking (from the age of formation of philosophy in Greece to the emergence of Kant) based on a historical and philosophical persecptive of legal theory.
