بررسي مشروعيت بين‌المللي گروه ويژه اقدام مالي (FATF) و اعتبار مقررات آن از ديدگاه اسناد بين‌المللي و رويۀ دولت ها

International legitimacy of the FATF and the validity of its ratifications from the perspective of international Instruments & State practice

مشروعيت بين‌المللي گروه ويژه اقدام مالي (FATF) در نظام حقوق بين‌الملل و اعتبار مصوبات آن از منظر رويۀ دولت‌ها و اسناد بين‌المللي همواره با نگاه ترديدآميز بعضي از صاحب‌نظران روبرو بوده است. به زعم اينان مصوبات و توصيه‌هاي گروه ويژه هنوز در قالب حقوق نرم بوده، نمي‌توان آنها را از منظر الزام‌آور بودن معتبر تلقي نمود. به‌نظر مي‌رسد تبلور عيني باور جامعۀ بين‌المللي نسبت به اسناد بين‌المللي حاكي از ارادۀ حقوقي‌اي است كه در تشكيل اين نهاد دخيل بوده، بر مشروعيت بين‌المللي و اعتبار مصوبات آن صحه مي‌گذارد. نويسندگان با توجه به پيوستن قابل توجه و گستردۀ كشورها به گروه ويژه و با استناد به اسناد بين‌المللي در پي اثبات اين فرضيه‌اند كه گروه ويژه در چارچوب حقوق بين‌الملل ازجمله حقوق بين‌الملل عرفي، اسناد بين‌المللي و رويۀ دولت‌ها داراي مشروعيت بين‌المللي و مصوبات آن از وصف الزام‌آور و اعتبار قانوني برخوردارند.

International legitimacy of the FATF and the validity of its codification in international system from the point of view of international custom and documents have always been questioned by some scholars with skepticism. They believe that the FATF recommendations and Codification are still in the form of soft law and cannot be validated and considered binding. It is appearing that the subjective perspective of the international community's belief in international documents indicates a legal will which has been an influence element in formation of FATF and its international legitimacy and the validity of its approvals.The authors, by attention to the joining majorityof countries to FATF, seek to prove this hypothesis that The FATF in the light of international law, customary international law, international documents and State practice caring international legitimacy, and its Ratifications legally are binding.
