نقش توسعه حقوق پزشكي در توسعه پايدار جغرافياي انساني؛ مطالعه موردي مسئوليت مدني پزشك در باروري‌هاي پزشكي

The role of medical law development in the sustainable development of human geography; A case study of physician civil liability in medical fertility

مسئوليت در قبال سلامتي انسان‌ها و داشتن جامعه سالم يكي از شرايط اصلي توسعه پايدار جغرافيايي- انساني است. بي شك عوامل بسياري در اين مساله تاثير گذارند كه توسعه حقوق پزشكي يكي از مهم‌ترين اين عوامل محسوب مي شود. تعهد در برابر سلامتي انسان ها و مراقبت از سلامتي نسل‌هاي آينده گامي اساسي به سوي شكل‌گيري ملتي توسعه يافته و مسئول در قبال محيط جغرافيايي است. هدف اين مقاله عبارت است از بررسي نقش توسعه حقوق پزشكي در توسعه پايدار جغرافياي انساني با تاكيد بر مسئوليت مدني پزشك در باروري‌هاي پزشكي است. سوال اصلي مقاله اين است كه توسعه حقوق پزشكي چه نقشي در توسعه پايدار جغرافياي انساني دارد؟ روش اين مقاله كيفي است. داده‌هاي مقاله از منابع كتابخانه اي گردآوري خواهند شد. شيوه تحليل يافته هاي پژوهش نيز توصيفي- تحليلي است. نتايج مقاله نشان مي‌دهد كه حفاظت و حمايت از سلامتي انسان ها در چارچوب نظامات حقوقي نقش مهمي در توسعه پايدار جغرافياي انساني دارد. از منظر حقوقي‌، پزشك وظايف معيني را ارائه مي دهد ودانش خود را در جهت حل مشكلات بهداشتي و درماني مردم به كار مي گيرد و بايد در برابر چهار نوع مسؤوليت پاسخگو باشد: مسؤوليت اخلاقي‌، مسؤوليت مدني‌(جبران خسارت توسط پزشك‌)، مسؤوليت انتظامي‌(نقض قوانين و مقررات صنفي و حرفه اي) و مسؤوليت كيفري‌(ارتكاب جرم بر اثر فعل يا ترك فعل).

Responsibility for human health and having a healthy society is one of the main conditions for sustainable geographical-human development. Undoubtedly, many factors influence this issue, and the development of medical law is one of the most important factors. Commitment to human health and caring for the health of future generations is a fundamental step towards the formation of a developed nation responsible for the geographical environment. The purpose of this article is to investigate the role of medical rights development in the sustainable development of human geography with emphasis on physician civil liability in medical fertility. The main question of the article is what role does the development of medical law play in the sustainable development of human geography? The method of this article is qualitative. Article data will be collected from library sources. The method of analysis of research findings is also descriptive-analytical. The results of the article show that the protection and protection of human health within the framework of legal systems has an important role in the sustainable development of human geography. From a legal point of view, the doctor performs certain duties an‎d uses its knowledge to solve people's health problems and must be held accountable for four types of responsibilities: Moral liability, civil liability (compensation by a physician), disciplinary liability (violation of trade unio‎n and professional rules and regulations) and criminal liability (committing a crime due to an act or omission).
