مسئوليت بين‌المللي ناتو در بحران‌هاي ژئوپليتيك از منظر حقوق بشردوستانه بين‌المللي

NATO's international responsibility for geopolitical crises from the perspective of international humanitarian law

هدف اين پژوهش، تبيين مسئوليت بين‌المللي ناتو در بحران‌هاي ژئوپليتيك از منظر حقوق بشردوستانه بين‌المللي است. روش پژوهش توصيفي - تحليلي است. شواهد نشان مي‌دهد، گسترش روزافزون ناتو به‌عنوان يك سازمان نظامي بين‌المللي در عرصه روابط بين‌الملل ازيك‌طرف باعث تحكيم روابط و مناسبات بين‌المللي شده است و از طرف ديگر باعث ايجاد مشكلات و ابهاماتي در چگونگي عملكرد و به‌تبع آن پذيرش مسئوليت توسط اين نهاد بين‌المللي گرديده است. در اين ميان ماهيت خاص ناتو سبب ابهامات بيشتري در حقوق بين‌الملل به‌خصوص در زمينه اجراي قواعد مسئوليت بين‌المللي شده است. ماهيت نظامي سازمان پيمان آتلانتيك شمالي (ناتو) سبب پررنگ‌تر شدن نقش اعضاء در عملكرد و جهت‌دهي به فعاليت‌هاي سازمان شده است. در نتيجه اين مسئله مي‌تواند در انتساب اعمال و ايجاد نوعي مسئوليت دوگانه يا مسئوليت هم‌زمان اعضاء و سازمان مؤثر باشد. پيشنهاد مي‌شود در ساختار ملل و مواد منشور ملل متحد تغييراتي ايجاد شود تا مسئوليت ناتو به‌عنوان يك سازمان نظامي از راهبرد دغدغه حقوق ملت‌ها به حقوق افراد تبديل گردد.

The purpose of this study is to explain NATO's international responsibility in geopolitical crises from the perspective of international humanitarian law. The research method is descriptive-analytical. Evidence shows that the growing expansion of NATO as an international military organization in the field of international relations has on the one hand strengthened international relations and on the other hand has caused problems and ambiguities in how it operates and consequently the acceptance of responsibility by this international body. Meanwhile, the special nature of NATO has caused more ambiguity in international law, especially in the implementation of the rules of international responsibility. The military nature of the North Atlantic Treaty Organization (NATO) has highlighted the role of members in the performance and direction of the organization's activities. As a result, it can be effective in assigning actions and creating a dual responsibility or simultaneous responsibility of members and the organization. It is suggested that changes be made to the structure of the nations and to the provisions of the Charter of the United Nations so that NATO's responsibility as a military organization shifts from a strategy of concern for the rights of nations to the rights of individuals.
