تاثير مولفه هاي جغرافيايي ، اجتماعي و امنيتي بر عقب گرد اخلاقي در رسيدگي به جرايم اخلال گران نظام اقتصادي ايران

The effect of geographical, social and security components on moral backwardness in dealing with crimes disrupting Iran's economic system

قرابت قوانين و مقررات با مؤلفه‌هاي اخلاقي، سبب مقبوليت و كارآمدي بيشتر آن‌ها مي شود. برهمكنش اخلاق و مقوله هاي جغرافيايي با موضوعات داخل در قلمرو حقوق كيفري نيز انكار ناپذير و از اقتضائات روز است. از سوي ديگر ناكارآمدي حقوق‌كيفري در پاسخ‌دهي مؤثر به جرايم اقتصادي و ضرورت حفظ نظم و امنيت جامعه در دوران كنوني (جنگ اقتصادي)، سبب كاربست سياست جنايي افتراقي جهت پاسخ دهي به اين جرايم در قالب تصويب «آيين‌نامه اجرايي نحوه رسيدگي به جرايم اخلالگران در نظام‌ اقتصادي‌ كشور مصوب 23/08/97» گرديده بود كه علي‌رغم قابليت انطباق با انديشه اخلاقي سودمدار، داراي جلوه‌هايي از عقب‌گرد اخلاقي نيز مي‌باشد. در اين مقاله به‌روش توصيفي-تحليلي با استفاده از منابع رايانه‌اي و كتابخانه‌اي با نگاهي اخلاقي به شناخت اين جلوه‌ها در جغرافياي سياست جنايي افتراقي حاكم بر اين دسته جرايم نظير:عبور از اصل‌برابري-سلاح‌ها، رويگرداني از اصل برائت، تسرّع در رسيدگي و... پرداخته‌ايم و با قيد راهكار، اصلاح شيوه مذكور با لحاظ آسيب‌شناسيِ صورت گرفته، به‌منظور همگاميِ بيشتر با آموزه‌هاي اخلاقي، اصول مسلم حقوق‌جزا و... و در نهايت پاسخ-دهيِ بهينه به اين جرايم و قضاوت عادلانه‌تر دستگاه قضايي جمهوري اسلامي ايران را ضروري دانستيم.

The closeness of the law and regulations to the ethical requirements considered to be a powerful support for their acceptability and efficiency. On the other hand , the inefficiency of the criminal law in response to the economic crimes and considering the necessity of maintaining the public interest and security in the present era (Economic war) has led to the formation of an approach in the form of “The Executive regulation by-law on how to deal with crimes of the corrupters in the country’s economic system and the establishment of the special economic crimes courts, approved on Nov. 14,2018” which despite its ability to adopt to the ethical theories of utilitarian it has shown sign of ethical retreats. In this article by using the descriptive and analytical methods as well as the computerized and library resources, we have studied some factors such as the equality of arms,ignorance of the principles of innocence, acceleration of the legal actions, and so we have suggested the solution that in order to keep pace with the ethics, religious teachings and certain principles of the criminal law the regulations and law should be revised and for the justice system to be more efficient and have better judgments this revision seems to be necessary.
