نگاهي به ابعاد حقوقي بيماريهاي مسري در صنعت هوانوردي با تاكيد بر بيماري كوويد- 19

A Study of the Legal Aspects of Contagious Diseases in Aviation Industry with Emphasis on Coronavirus Disease

صنعت هوانوردي و حقوق آن از دو جهت به ظهور و همه گيري بيماريهاي مسري حساس است و واكنش نشان مي دهد. از يك سو ممكن است اين صنعت با عدم اتخاذ اقدامات موثر در شيوع بيماري نقش داشته باشد و حيات جامعه را با خطر روبرو كند و از سوي ديگر محتمل است كه با بروز امراض مسري، چرخه اقتصادي بازيگران و ذينفعان صنعت به شدت تهديد و درگير مشكلات فراوان شود، امري كه در نهايت به ضرر اقتصاد كل تمام ميگردد. تحقيقات بر اين واقعيت تاكيد دارند كه هنجارها و قواعد مربوط به مقابله با شيوع بيماري از طريق ناوبري هوايي عمدتاً از بطن حقوق بين الملل و حقوق منطقه اي بيرون ميآيند ولي هنجارها و قواعد مربوط به مقابله با اثرات اقتصادي حاصل از شيوع امراض مسري بر صنعت هوانوردي، بيشتر زاييده حقوق ملي كشورها هستند. اين مقاله بر ساختار و بنيان همين تقسيم و با روش كتابخانه اي، ابعاد حقوقي بيماري هاي مسري را در صنعت هوانوردي با تاكيد بر بيماري كوويد- 19 مورد تحليل و بررسي قرار مي دهد. نتيجه مقاله حاكي از آن است كه حقوق بيماري هاي مسري در صنعت هوانوردي، حقوقي است با سه خصيصه يا ويژگي مهم: «تعاوني و مبتني بر همكاري»، «حمايتي» و «موقت يا غير دائمي».

The Aviation Industry and its governing law are vulnerable to the outbreak and pandemic of contagious diseases. It is possible that the industry takes part in the spread of disease and endanger lives, while on the other hand, with the spread of contagious diseases, the economic cycle of actors and beneficiaries of the aviation industry is seriously threatened and faced with numerous difficulties, which eventually is to the detriment of the economy in whole. Studies illustrate that the norms and rules related to counter the spreading of disease through air navigation are mainly taken from the International and regional laws but the norms and rules dealing with the economic effects of such pandemics are largely attained from national laws. This article, using the same structure and classification, analyzes legal aspects of contagious diseases in the aviation industry with emphasis on the novel Coronavirus disease. The results indicate that the law of contagious diseases in the aviation industry should have three important characteristics: “cooperative or collaborative”, “supportive” and “temporary”.
