چكيده فارسي :
در دﻋﺎوي ﻣﺪﻧﯽ، ﺑﺮﺧﻼف ﺟﺮاﺋﻢ ﮐﯿﻔﺮي، دادرس ﺑﻪ ﻣﻮﺟﺐ اﺻﻞ ﺑﯽﻃﺮﻓﯽ، ﺣﻖ ﻧﺪارد ﮐــﻪ ﻣﺴــﺘﻘﯿﻤﺎً ﺑــﻪ ﺟﻤﻊآوري دﻟﯿﻞ اﺛﺒﺎت ﻣﺪﻋﺎ ﺑﻪ ﻧﻔﻊ ﯾﮑﯽ از ﻃﺮﻓﯿﻦ دﻋﻮا اﻗﺪام ﮐﺮده ﮐﻪ از آن ﺑﺎ ﻧﺎم ﻗﺎﻋــﺪه ﻣﻨــﻊ ﺗﺤﺼــﯿﻞ دﻟﯿﻞ ﻧﺎم ﻣﯽﺑﺮﻧﺪ. اﯾﻦ ﭘﮋوﻫﺶ ﺑﻪ روش ﺗﺤﻠﯿﻠﯽ- ﺗﻮﺻﯿﻔﯽ ﺑﻪ ﺑﺤﺚ در ﻣــﻮرد ﮐــﺎرﺑﺮد ﻗﺎﻋــﺪه ﻣــﺬﮐﻮر در دﻋﺎوي زوﺟﯿﻦ ﮐﻪ ﻧﻮع ﺧﺎﺻﯽ از دﻋﺎوي ﻣﺪﻧﯽ ﻣﯽﺑﺎﺷﺪ، ﭘﺮداﺧﺘﻪ اﺳﺖ. ﻧﺘﺎﯾﺞ ﺣﺎﮐﯽ از آن اﺳﺖ ﮐــﻪ در ﻣﻮاردي ﮐﻪ ﺟﺮم در دﻋﺎوي ﺑﯿﻦ زوﺟﯿﻦ ﺣﺎدث ﺷﺪه، ﻣﯽﺗﻮان ﺑﻪ ﻣﻮﺟﺐ ﻗﺎﻧﻮن آﺋــﯿﻦ دادرﺳــﯽ ﮐﯿﻔــﺮي، ﻧﺴﺒﺖ ﺑﻪ ﺗﺤﻘﯿﻘﺎت اﻗﺪام ﮐﺮد. ﺗﺤﻘﯿﻘﺎت ﻣﺤﻠﯽ ﺑﻪ ﻣﻮﺟﺐ ق.آ.د.م در اﺧﺘﯿﺎر ﻗﺎﺿﯽ ﻗﺮار دارد و ﻣﯽﺗﻮاﻧــﺪ ﺑﻪ اﺳﺘﻨﺎد آن، ﮐﻪ ﻋﻠﻢ ﺧﻮد را ﻣﺘﺄﺛﺮ ﮐﺮده، ﺣﮑﻢ ﺻﺎدر ﮐﻨﺪ. در ﻣﻮاردي ﻧﯿﺰ ﺿﻤﻦ ﻣﺼﺎﺣﺒﻪﻫﺎي دوﻃﺮﻓﻪ، ﺑﺎ ﺣﻔﻆ اﺻﻞ ﺑﯽﻃﺮﻓﯽ ﻧﺴﺒﺖ ﺑﻪ اﻗﺮار ﺣﻘﯿﻘﺖ از زﺑﺎن زوﺟﯿﻦ اﻗﺪام ﺷﺪه و ﺑﻪ ﺻﻮرت ﮐﻠﯽ ﻣﯽﺗﻮان ﻧﺘﯿﺠــﻪ ﮔﺮﻓﺖ ﮐﻪ ﻗﺎﻋﺪه ﻣﻨﻊ ﺗﺤﺼﯿﻞ دﻟﯿﻞ، ﻗﺎﻋﺪهاي ﮐﺎﻣﻼً ﻣﻄﻠﻖ ﻧﺒﻮده و در ﭼﺎرﭼﻮب اﺻﻞ ﺑﯽﻃﺮﻓﯽ ﻣــﯽﺗــﻮان اﻗﺪاﻣﺎﺗﯽ در ﺟﻬﺖ ﺗﺤﺼﯿﻞ دﻟﯿﻞ اﻧﺠﺎم داد ﮐﻪ در دﻋﺎوي زوﺟﯿﻦ ﺑﻪ ﻧﺴﺒﺖ دﯾﮕﺮ دﻋﺎوي ﻣﺪﻧﯽ، اﻧﻌﻄــﺎف ﺗﻌﺪﯾﻞ اﯾﻦ ﻗﺎﻋﺪه ﺑﯿﺸﺘﺮ اﺳﺖ.
چكيده لاتين :
In civil litigation, unlike criminal offenses, the judge, according to the principle of
impartiality, has no right to directly collect the evidence of the claim in favor of one of
the litigants, which is called the prohibition rule. This research uses analyticaldescriptive
method to discuss the application of this rule in litigation of couples, which
is a special type of civil litigation. In this research, the aim is to investigate the
application of the rule of prohibition of reason in family lawsuits. It was concluded that
in cases where the crime occurred in litigation between spouses, it is possible to conduct
an investigation in accordance with the Code of Criminal Procedure. The local
investigation is under the jurisdiction of the judge, according to which he can issue a
verdict based on which he has influenced his knowledge. In some cases, in addition to
two-way interviews, the principle of neutrality is used to acknowledge the truth in the
language of the couple, and in general, it can be concluded that the rule prohibiting the
study of evidence is not a completely absolute rule and within the framework of the
principle On the other hand, measures can be taken to obtain evidence that couples'
litigation is more flexible than other civil litigation
