Restrictions on Freedom of Expression; Justifications and Documentation

آزادي بيان به معناي حق اظهار عقايد و افكار، و ابراز عواطف و احساسات به روش‌هاي گوناگون، از حقوق بنيادين بشر محسوب مي‌شود؛ حقي مبتني بر كرامت ذاتي بشر كه همه اولاد آدم به‌گونه‌اي برابر از آن برخوردارند. حق آزادي بيان همچون ساير حقوق و آزادي‌هاي فردي، در توازن با مسؤوليت اجتماعي افراد قرار مي‌گيرد. موازنۀ حق و مسؤوليت خود به خود موجب محدوديت حقوق افراد از جمله حق آزادي بيان آنان مي‌گردد. الزامات زيستِ جمعي، حفظ كرامت بشر و اصل منع ايراد ضرر به ديگران، مباني مسؤوليت اجتماعي افراد و محدوديت آزادي‌هاي آنان هستند. اين مباني موجب شده‌اند تا اسناد بين‌المللي و منطقه‌اي حقوق بشر، موازين اسلامي و قوانين موضوعۀ ملي، آزادي بيان را به نفع ارزش‌هايي ديگر مثل حقوق و آزادي‌هاي ديگران، مقتضيات صحيح اخلاقي، نظم اجتماعي و مصلحت عمومي محدود كنند. اين مقاله به روش كتابخانه‌اي و از طريق تحليل محتواي اسناد به بررسي محدوديت‌هاي آزادي بيان مي‌پردازد و به سؤالي كه در اين زمينه مطرح است پاسخ مستدل و مستند مي‌دهد.

Freedom of expression, i.e., the permission to express thoughts, ideas, emotions and sensibility in various ways, is a fundamental human right; a right based on the inherent dignity of human beings. The right to freedom of expression, like other individual rights and freedoms, is balanced with the social responsibility. This balance of rights and responsibilities automatically restricts the rights of individuals, including their right to freedom of speech. The requirements of collective life, the preservation of human dignity and the principle of non-harm to others are the foundations of individuals' social responsibility and the restriction of their freedoms. These principles have led to international and regional human rights instruments, Islamic norms and national laws restricting freedom of expression in favor of other values such as the rights and freedoms of others, the just requirements of morality, social order and the public interest. This library research examines the restrictions on freedom of speech by analyzing document contents.
