چكيده فارسي :
آفريده‌هاي فكري مد يا عنصر حياتي صنعت مد از ارزش اقتصادي هنگفتي برخوردارند. چون رويكرد اصلي حمايت كيفري ارزش‌گرايي است، تلقي مد به‌عنوان ارزش موضوع حمايت كيفري در نظام كيفري ايران با چالش‌هايي در زمينۀ جرم‌انگاري و تعيين ضمانت اجرا روبه‌روست كه اين پرسش را طرح كرده: موازين جرم‌انگاري، مباني، معيارها و مصاديق و تناسب ضمانت اجراها چقدر مورد توجه قانون‌گذار بوده است؟ اين پژوهش با روش توصيفي ـ تحليلي و با بررسي منابع كتابخانه‌اي، و در بخش تطبيقي با استفاده از منابع اينترنتي معتبر در قالب كتب، مقالات و متون قانوني حقوق مالكيت فكري مرتبط با حمايت از آثار فكري ـ هنري مد به ارزيابي ميزان رعايت موازين جرم‌انگاري، مباني و معيارها و مصاديق در نظام‌هاي حقوقي ايران، فرانسه و امريكا پرداخته است. مطالعۀ حمايت‌هاي حقوق مالكيت فكري متناظر با آفريده‌هاي فكري يا طرح‌هاي مد در نظام حقوقي ايران، فرانسه و امريكا نشان مي‌دهد اگرچه، براي مد، نظام حمايتي كلي زير عنوان‌هايي كه مستقيماً دربارۀ مد نيستند وجود دارد، امّا تصريح جايگاه اين آثار در قانون، جرم‌انگاري رفتارهاي ضرري اصلي، بازتوليد و صور پخش مغفول مانده است. نتيجۀ پژوهش نشان مي‌دهد حمايت كيفري از آثار فكري ـ هنري مد در نظام‌هاي فرانسه و بعضاً آمريكا بر موازين جرم‌انگاري مبتني بوده و در تعيين ضمانت اجراها به ماهيت نوآورانه، هنري و اقتصادي آفريده‌هاي فكري مد توجه شده؛ اما، در ايران، نابسندگي رعايت موازين جرم‌انگاري رفتارهاي نقض حق و عدم تناسب و نابسندگي ضمانت اجراهاي موجود از چالش‌هاي عمدۀ حمايت كيفري به شمار مي‌آيند.
چكيده لاتين :
fashion Intellectual creation, the vital element of the fashion industry, is of great economic value. As the main approach of criminal support is value oriented, considering fashion to be a value in criminal support in the Iranian penal system is faced with challenges in some areas, such as criminalization and determining the sanction. This raises the following question: To what extent have the lawmakers focused on the standards of criminalization, basic principles, criteria, applicability, and the proportionality of sanction. Given the Iran and the French legal system as a relatively suitable criminal supporting system, as well as the United States, it seems that, although some support has been given to these intellectual creations under some headings in intellectual property law, major challenges still remain. The methods of interpretation and analysis of the Penal and Intellectual property law, and library resources have been used in the research to evaluate of conformity of standards of criminalization, and their applicability in the legal systems of Iran, France, and the United States. Findings demonstrates that criminal supporting in the fashion industry in the French and American systems is based on criminalization and attention has been paid to the economic nature and wealth creation of intellectual works, including intellectual creations in fashion, when determining the guarantee of execution. In Iran, however, inadequate standards of criminalization, copyright infringement, and determining the guarantee of appropriate execution have created challenges in the criminal supporting of fashion creations.
