Civil liability of Sports Clubs During the Covid 19 Virus Pandemic

مسئوليت مدني از مباحث مهم حقوقي است كه علاوه بر فرد زيان‌ديده و فرد وارد‌كننده زيان، از نظر جامعه نيز كاركرد و اهميت خاص دارد. هدف از انجام پژوهش حاضر بررسي مسئوليت مدني باشگاه‌هاي ورزشي در زمان همه‌گيري ويروس كوويد 19 بود. اين پژوهش به روش كيفي و با استفاده از روش تحليل مضمون انجام شد. جامعه آماري پژوهش خبرگان حقوق و حقوق ورزشي، اساتيد مديريت ورزشي و آشنا با مباحث حقوق ورزش، كارشناسان رسمي دادگستري در حوادث ورزشي و مربيان و مسئولان باشگاه ها بودند. نمونه‌گيري به صورت هدفمند و به روش نظري انجام شد. ابزار گردآوري داده‌ها مصاحبة عميق نيمه ساختاريافته بود. در اين پژوهش محقق پس از نه مصاحبه به اشباع نظري رسيد. اما براي افزايش ضريب اطمينان سه مصاحبه ديگر انجام شد. براي تجزيه و تحليل داده‌ها از نرم افزار مكس كيو دي آ نسخه 10 استفاده گرديد. يافته‌ها حاكي از اين بود كه مسئوليت مدني باشگاه‌هاي ورزشي در دوران شيوع ويروس كوويد 19 شامل الزام به رعايت نكات ايمني و الزام به رعايت نكات بهداشتي و اقدامات بازدارنده است كه در دو مورد اول باشگاه‌ها به خوبي عمل كرده‌اند اما در ارتباط با اقدامات بازدارنده فعاليت خاصي صورت نگرفته است. با توجه به يافته‌هاي تحقيق و اينكه عدم انجام فعاليت هاي بازدارنده مي‌تواند پيامدهاي قانوني براي باشگاه ها به همراه داشته باشد، ارائه آگاهي و آموزش هاي لازم در اين زمينه و مسئوليت‌هايي كه ممكن است براي مربيان و مسئولان باشگاه‌ها ايجاد شود، ضروري به نظر مي‌رسد.

Civil liability is one of the important legal issues that in addition to the injured party and the person causing the damage, also has a special function and importance from the society’s point of view. The aim of this study was to investigate the civil liability of sports clubs during the Covid 19 virus epidemic. This research was conducted qualitatively using content analysis method. The statistical population of the study were Law and sports law experts, sports management professor’s familiar with sports law topics, Official experts of the judiciary in sports incidents, and coaches and club officials. Sampling was done purposefully and theoretically. The data collection tool was an in-depth semi-structured interview. In this research, the researcher reached theoretical saturation after 9 interviews, but 3 more interviews were conducted to increase the reliability. MAXQDA software version 10 was used for data analysis. The findings indicated that the civil liability of sports clubs during the covid 19 virus epidemic included adherence to safety and health requirements and deterrent measures, which worked well in the first two cases, but in relation to preventive action, no specific activity has been performed. Given the findings of the research and the fact that not taking preventive activities can have legal consequences for clubs, provide the necessary knowledge and training in this area and the responsibilities that may be for coaches and club officials, seems necessary to create.
