بايسته‌هاي كشف جرائم اقتصادي با تأكيد بر مشاركت نهادهاي انتظامي و قضايي

زمينه و هدف: پيچيدگي جرائم اقتصادي و دغدغۀ روزافزون سياست كيفري ايران در خصوص لزوم مقابلۀّ جدي اين جرائم و كاهش ميزان وقوع آن‌ها، به رويكرد چند نهادي در مبارزه با اين جرائم ضرورت ويژه‌اي بخشيده است. افزايش حداكثري كشف جرائم اقتصادي و ترس بزهكاران مربوطه، هدف اساسي مشاركت ميان نهادهاي قضايي و انتظامي مانند پليس امنيت اقتصادي است و هدف نگارندگان در اين تحقيق اين بوده است تا با آسيب‌شناسي وضعيت قضايي و انتظامي كشف جرائم اقتصادي، نسبت به تبيين راهكارهاي برون‌رفت از چالش‌هاي مطرح در مسير مشاركت انتظامي- قضايي در كشف اين جرائم پرداخته شود. روش: نظر به ماهيت موضوع، پژوهش حاضر ازنظر گردآوري اطلاعات به روش اسنادي و از طريق مطالعات تحقيقات معتبر، كتب، مقالات، قوانين و مقررات موجود و آراء محاكم قضايي انجام شده است. اطلاعات به‌دست‌آمده به‌صورت توصيفي مورد تجزيه و تحليل قرار گرفته است. يافته‌ها: آغاز فعاليت پليس امنيت اقتصادي از سال 1398 و عدم ساماندهي تعامل آن با مراجع قضايي، چالش‌هايي را به همراه داشته است و مراجع قضايي كماكان به نهادهاي اطلاعاتي متوسل مي‌شوند. به نظر مي‌رسد كه نبود مقررات مرتبط با شيوه‌نامه عملكرد اين نهاد در كنار كنشگران قضايي، اقدامات آن را در حد عنوان ضابط قضايي تنزل مي‌دهد و مشاركت در اتخاذ اقدامات واكنشي، نسبت به جرائم اقتصادي را با ضعف اساسي روبه‌رو مي‌كند. نتيجه‌گيري: افتراقي‌سازي شيوۀ كشف جرائم اقتصادي، با نظر به جرائم اقتصادي برخاسته از محيط اداري و جرائم اقتصادي برخاسته از محيط تجاري-شغلي، آموزش قضايي به پليس امنيت اقتصادي، تصويب الگوي جامع عملكرد مشاركت محور در قالب آيين‌نامه مشخص و تعيين وظايف و اختيارات متفاوت پليس امنيت اقتصادي با ساير ضابطان قضايي از اهم نتايج است.

The complexity of economic crimes and the increasing concern of Iran's criminal policy regarding the increased risk of committing these crimes and reducing their incidence have made the multidisciplinary approach to combating these crimes particularly important. Maximizing the discovery of economic crimes and the associated fears of criminals is a key objective of partnerships between law enforcement and law enforcement agencies such as the Economic Security Police, however, multipliers should not lead to procedural division as well as unregulated participation. Therefore, police-judicial partnership policymaking is an approach in which the integrity of the performance and specification of the tasks of each of these institutions in combating economic crime are pursued. Methodology: Depending on the nature of the subject, the present study was conducted through documentary methodological studies, through studies of valid research, books, articles, laws and regulations, judicial opinions, and reputable websites. The information obtained is descriptively analyzed. Findings: The beginning of economic security police activity in 1398 and its increasing interaction with the judicial authorities has posed some challenges. The absence of rules governing the institution's style of conduct with judicial actors appears to diminish its actions as a matter of judicial authority and complicate participation in the response to economic crime. Results: Differentiate economic crime discovery method with respect to economic crime arising from administrative environment and economic crime arising from business-occupational environment, judicial training to economic security police, adoption of a comprehensive participatory-centered pattern of practice in the form of specific bylaws, and assignment of duties and powers. Differences in economic security with other judicial officers are of great importance.
