بي تابعيتي ناشي از ازدواج زنان ايراني با مردان افغان در استان كرمان و تاثير آن بر نظم و امنيت عمومي

بحث حضور مهاجران افغان در استان كرمان داراي ابعاد گسترده­اي است و طيف وسيعي از فرصت­ها و تهديدها را ايجاد ميكند. ازدواج يكي از مهمترين مسائل پيش رو ميباشد كه با توجه به اشكالات قوانين مصوب و گستردگي آن در جنوب استان كرمان بحران­هايي را ايجاد كرده­است. لذا در اين تحقيق با نگاهي بومي كه قابل تسري به ‌سياست‌هاي كلي تابعيت‌ ‌‌‌‌مي‌باشد برآنيم كه از وضعيت‌‌ بي‌تابعيتي جلوگيري كنيم‌‌. همچنين اين پژوهش كوششي است براي شناخت آسيب‌ها و موانع موجود و ارتباط موثر با اتباع افغان به منظور تثبيت امنيت استان و در انتهاي هر بحث راهكارهايي براي بهبود وضعيت ارائه گشته است‌. روش شناسي: اين تحقيق از نوع كاربردي بر پايه مطالعات اسنادي و ميداني از نوع كيفي بر‌‌‌‌ پايه­‌ي مصاحبه با كارشناسان و متخصصان است‌. يافته­ها: براساس مطالعات انجام شده فرزندان حاصل از ازدواج زنان ايراني با مردان افغان با مشكل جدي بي­تابعيتي (دائم و موقت) مواجه ميباشند و عدم حمايت دولت­ها از چنين افرادي باعث محروميت آنها از خدمات عمومي و به دنبال آن خطرات امنيتي انتظامي مي­گردد. بنابراين علل ايجاد بي تابعيتي گسترده، مشكلات و موانع قانوني و راه حل­هاي اين مساله مورد بررسي قرار گرفته­است. نتايج: در پايان طرح براي جلوگيري از‌‌ بي‌تابعيتي گسترده‌‌، استفاده از سيستم خون براي اعطاي تابعيت از طريق مادر و يا تفسير موسع از ماده­ي 976 قانون مدني به منظور اعطاي تابعيت بوسيله مادر پيشنهاد ‌مي‌گردد‌. از طرف ديگر به نظر مي‌رسد سياست­هاي كلان ايران در رابطه با نحوه­ي اعطاي تابعيت و كنترل جمعيت با توجه به شرايط امروز جامعه قابل تغيير و بهبود است. بنابراين اصلاح قوانين اعطاي تابعيت به منظور ايجاد تغييرات جمعيتي و نخبه سالاري به طرق مختلف بيان شده است.

Context and purpose: The subject of the Afghans’ presence in Kerman province has widespread dimensions, and it makes a wide range of opportunities and threats. International marriage is one of the most important issues that because of the legal incompetency and expansion of that in the south of Kerman created special crises. So, in this research according to a local view that is applicable for general national policies, we try to prevent creating statelessness. Also, this article is a kind of effort for understanding the existing harm, obstacles and effective communication with afghans in order to fixing province security.
Methodology: This research is practical based on documentary and field studies and it is qualitative type based on interviewing with experts.
Data: According to this study, the children of Iranian women and their Afghans’ husbands are struggling with the serious statelessness problems, and lack government support from these people deprives them of public services and leads to security risks. Thus, the reasons of creating statelessness, legal problems and obstacles and the solutions of the issue are studied.
Results: At the end of the research, to prevent widespread statelessness, using of blood system via Iranian mothers or extensive interpretation of article 976 civil act in order to granting citizenship by mothers are offered. In addition, it seems that, according to our social situation, Iranian general policies regarding to the citizenship granting and population controlling can be changed and improved. So, reformation of citizenship granting regulations for the sake of population changing and establishing elite rule will be necessary.
