هدف پژوهش حاضر بررسي آثار فقهي كلامي مسأله ولايت فقيه است. روش پژوهش توصيفي- تحليلي بوده و نتايج نشان داد كه ولايت فقيه پويا، متحرك و سازنده جامعه انساني است. بايستگي آن در عصر غيبت بر اساس قاعده لطف به اثبات رسيده است. مبناي مشروعيت مقام ولايت براي ولي امر مسلمين، تجلي الهي مي‌باشد. ثقل بحث مسأله ولايت فقيه مبنا و دليل مشروعيت ولايت فقيه است كه بررسي بحث مشروعيت فقط در علم كلام و به نوعي به اصول دين و بحث توحيد و فعل الهي بازگشت دارد، متصور است. همه مسلمانان جهان موظف به اطاعت از ولي هستند. حكومت ولايت فقيه براساس كلامي بودن، به همه شوون جامعه اسلامي تعميم دارد، به نوعي به مبحث توحيد و فعل الهي مربوط شده و ايمان و پذيرش ولايت بايد در اعتقادات مكلفان باشد و به مسائل و فروع فقهي ربطي پيدا نمي‌كند.
