مسئوليت ناشي از سلب فرصت درمان، عنصر مفقود در پرونده‌هاي خطاي پزشكي

رجوع بيمار به پزشك باهدف پيشگيري از بيماري احتمالي آينده يا درمان بيماري حادث‌شده صورت مي‌گيرد. اگرچه در غالب موارد چنين هدفي محقق مي‌شود، ليكن مواردي نيز قابل‌ ذكر است كه عدم‌تشخيص صحيح يا تأخير در انجام آن، سبب از ميان رفتن فرصت درمان مؤثر مي‌شود. سلب چنين فرصتي داراي مراتبي است كه از تأخير در بهبودي آغاز گرديده و تا خاتمه حيات بيمار ممكن است در نوسان باشد. بديهي است در صورت تجميع شرايطِ وجود وظيفه درمان، حدوث ضرر و اثبات رابطه سببيت، سلب فرصت درمان نيز مي‌بايست در زمره يكي از صور تحقق مسئوليت مدنظر قرار گيرد. مداقه در آراي مرتبط با دعاوي تقصير و خطاهاي صاحبان حرف پزشكي حاكي از آن ‌است كه تحقق مسئوليت صاحبان اين حرف، منحصراً بر اساس ضرر حادث‌شده نهايي سنجيده مي‌شود. اين در حالي است كه صرف محروم ماندن بيمار از فرصت درمان نيز مي‌تواند با احراز شرايطي منتهي به تحقق مسئوليت گردد.
