A Study on Duties of the Islamic Government and Principles of Human Rights on the Right to Social Security

هدف: حق بر تأمين اجتماعي از ابتدايي‌ترين حقوق بشري است كه در اسناد حقوق بشري به‌عنوان نسل دوم حقوق بشر آمده است. يكي از مهم‌ترين و اساسي‌ترين موضوعات در زمان حاكميت حكومت اسلامي چگونگي برخورد با موضوعات جديد و يافتن سابقه و به عبارت ديگر، حقيقت شرعيه يا متشرعه است. از جملۀ اين مسائل مسئلۀ حق بر تأمين اجتماعي است كه مي‌تواند يك موضوع انساني، حقوقي و فقهي داراي ابعاد فراوان اجتماعي و فردي در عصر حاضر باشد. هدف از پژوهش حاضر بررسي حق مردم بر تأمين اجتماعي در دولت اسلامي و مباني حقوق بشري بر حق تأمين اجتماعي است. اين اصل در قوانين داخلي كشورها نيز وارد شده است، و جمهوري اسلامي ايران نيز در قانون اساسي و قوانين عادي به اين اصل مهم توجه داشته است. روش: پژوهش حاضر با استفاده از روش توصيفي– تحليلي و با بررسي اصل 29 قانون اساسي و معاهدات حقوق بشري نگاشته شده است. يافته‌ها و نتيجه: نتايج اين مطالعه نشان مي‌دهد ازآنجاكه رفاه اجتماعي نوين با هر نوع نگرش، بيش از آنكه بر گروه‌هاي آسيب‌ديده متمركز باشد، اصلي‌ترين هدف خود را بر جلوگيري از گسترش آسيب و بروز موارد جديد قرار مي‌دهد، اين مدل مطلوب بايد بتواند به‌جاي آنكه فقط گروه‌هاي آسيب‌ديده را مدنظر قرار دهد، در همۀ سطوح موردانتظار فعاليت كند و حيطۀ عمل خود را به تمام آحاد جامعه از نظر پيشگيري از بروز آسيب‌ديدگي تعميم دهد.

Objective: The right to social security is one of the most basic human rights, which is considered as the second generation of human rights in related documents. One of the most important and fundamental issues during the governance of an Islamic government is how to deal with new issues and find its background; in other words, among these issues, the right to social security is a human, legal and jurisprudential issue with many social and individual dimensions in the present era. The purpose of this study is to investigate the right of the people to social security in an Islamic state and the principles of human rights on the right to social security. This principle has been included in the domestic laws of countries, and the Islamic Republic of Iran has also paid attention to this important principle in its Constitution and ordinary laws. Method: The present study is written using a descriptive-analytical method and reviewing Article 29 of the Constitution and human rights treaties. Findings: The results of this study show that the main goal of new social welfare system, with any kind of attitude, is to prevent the spread of harm and the emergence of new cases rather than focusing on the affected groups. Therefore, this model should be able to operate at all expected levels and extend its scope of action to all members of society in terms of preventing the occurrence of injury, instead of focusing only on the affected groups.
