The empowerment requirements of civil society in strengthening Iran's participatory criminal policy

زمينه و هدف: تحليل كاربست حداكثر ظرفيت موجودِ عناصر جامعه مدني در مردم ايران براي تقويت سياست جنايي مشاركتي، موضوع اين پژوهش است. مواد و روش‌ها: روش پژوهش حاضر توصيف محتواي كيفي است و با جمع‌آوري اطلاعات از منابع حقوقي نگاشته شده است. يافته‌ها: مشاركت جامعه مدني، نظام ‌دادرسي كيفري را از رسمي‌بودنِ محض خارج مي‌سازد و از حجم قضا‌گرايي رسمي مي‌كاهد تا بدين وسيله بتواند كارايي دستگاه عدالت كيفري را در حوزه‌هايي چون پيشگيري از جرم و مبارزۀ كارآمد با نرخ كلي جرايم ارتكابي ارتقا بخشد. ملاحظات اخلاقي: در اين مقاله سعي شده است ضمن رعايت اصالت متون، صداقت و امانت‌داري رعايت شود. نتيجه گيري: مشاركتي شدن سياست جنايي به معناي فاصله‌گرفتن از سياست‌كيفري سركوبگرانه و دولتيِ محض و حضور جامعۀ مدني در كليۀ مراحل و فرايندهاي حقوقي است كه بتواند در كنار نهادهاي رسمي، دادگستري، بزهكاران و بزه‌ديدگان در حل و فصل منازعات حقوقي و اجراي تدابير و طرح‌هاي مختلف پيشگيري از جرم نقش و مداخله داشته باشد.

Background and Aim: Analysis of the use of the maximum available capacity of civil society elements in the Iranian people to strengthen participatory criminal policy is the subject of this study. Materials and Methods: The present research method is a description of qualitative content and has been written by collecting information from legal sources. Findings: The participation of civil society removes the criminal justice system from its mere formality and reduces the volume of formal judiciary so that it can improve the efficiency of the criminal justice system in areas such as crime prevention and efficient fight against the overall crime rate. Ethical considerations: In this article, we have tried to observe the originality of the texts, honesty and trustworthiness. Conclusion: Participation of criminal policy means distancing oneself from repressive criminal government and pure government and the presence of civil society in all legal stages and processes that can work with official institutions, judiciary, criminals and victims in resolving legal disputes and implementing measures. an‎d various crime prevention plans have a role and intervention.
