The Function of Property Element and it's Effect on the Economy Based on a Jurisprudential-Legal Approach

زمينه و هدف: قانون گذاران نيز در جوامع مختلف با اتكا بر معيارهاي مختلفي سعي در حمايت از دارايي و اموال شهروندان داشته اند تا منافع آنها به شكل مناسب تري تأمين گردد، يكي از اين معيار ها، معيار اقتصادي مي باشد، الهام‌گيري و ارائه نگاه اقتصادي در ارتباط با اموال، آثار متنوعي را به همراه خواهد داشت و ديدگاه‌هاي جديدي را خلق مي‌نمايد كه در پژوهش حاضر به اين مهم پرداخته خواهد شد. يافته‌ها: اساساً صرف اينكه شيء در معرض مبادله قرار بگيرد و افراد در مقابل آن بهايي بپردازند، آن را واجد ارزش مال مي نمايد و اساساً هر چيزي كه به ازاي آن مالي داده شود، مال ناميده مي شود. عرف نيز چنين مواردي را مال تلقي نموده و براي آن ماليت و ارزش اقتصادي قائل شده است. مالكيت نيز بيانگر رابطه‌اي مي‌باشد كه بين شخص و شيء مادي قرار گرفته و قانون نيز آن را معتبر مي‌شناسد و به مالك اين اجازه را مي دهد كه نهايت انتفاع را از آن مال ببرد و كسي نتواند از آن جلوگيري نمايد. ملاحظات اخلاقي: در تمام مراحل نگارش پژوهش حاضر، ضمن رعايت اصالت متون، صداقت و امانت‌داري رعايت شده است. نتيجه‌گيري: رويكرد اقتصادي به عنصر مال اين امر را اثبات مي‌ناميد كه با توجه به تحولات حوزه-ي اقتصاد بايد براي «مال» قلمداد كردن هر چيز، منافع آن در جامعه و نحوه‌ي برخورد عرف با آن را در نظر بگيريم.

Background and Aim: Legislators in different societies, relying on different criteria, have tried to protect the property and assets of citizens to better serve their interests. One of these criteria is the economic criterion, inspiring and providing an economic perspective on Property will have a variety of effects and create new perspectives that will be addressed in this study. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings: Basically, just because an object is traded and people pay a price for it, it makes the property worthwhile, and basically anything that is paid for is called property. Custom has also considered such cases as property and has given them tax and economic value. Ownership also refers to the relationship that exists between a person and a material object, and the law recognizes it as valid and allows the owner to take full advantage of that property and no one can prevent it. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The economic approach to the element of property proves that in view of the developments in the field of economics, in order to consider everything as "property", we must consider its interests in society and the way in which custom deals with it.
