پيشگيري نوين از جرائم ثبتي همگرا با سياست كيفري بر اقتصاد از منظر فقه و حقوق

Modern prevention of registration crimes in line with criminal policy on economics from the perspective of jurisprudence and law

زمينه و هدف: مسائل ثبتي در دادسراها و دادگاه‌ها يكي از مسائل حقوقي دوران معاصر هستند. پژوهش حاضر به پيشگيري نوين از جرائم ثبتي با توجه به همگرايي با سياست كيفري-اقتصادي در پرتو فقه اسلامي و حقوق مي‌پردازد. مواد و روش‌ها: در مطالعه حاضر از روش تحليل محتواي كيفي استفاده شده است و اطلاعات نيز به شيوه اسنادي و كتابخانه‌اي جمع‌آوري شده است. يافته‌ها: همگرايي سياست كيفري و تدوين قانون در حوزه مقابله با جرايم ثبتي نيازمند اعتباربخشي به اسناد رسمي، برقراري نظم و قانون در حوزه اسناد رسمي، تقدم بخشيدن به اسناد رسمي بر عادي، الكترونيكي كردن دفاتر اسناد، و مبنا قرار دادن آگاهي از قوانين به جاي مماشات و اينكه افراد مختلف، به قانون آگاهي ندارند، بخش مهمي از راهكارهاي مقابله با جرايم در حوزه ثبت است. ملاحظات اخلاقي: مطالعه حاضر با مبنا قرار دادن اصول اخلاقي از جمله استفاده دقيق و علمي از منابع تحقيق نگارش شده است. نتيجه گيري: همپايي تدابير سياست كيفري با شيوه‌هاي نوين پيشگيري، اعطاي نقش پيشگيري به متوليان سياست كيفري، همگرايي سياست كيفري با تدابير پيشگيري در مراحل بازرسي و كشف جرم و حمايت سياست كيفري از تدابير پيشگيري مبتني بر ثبت الكترونيكي شيوه‌هاي نوين پيشگيري از جرم محسوب مي-شوند.

Background and Aim: Registration issues in courts and tribunals are one of the legal issues of the contemporary era. The present study deals with the new prevention of registration crimes with respect to convergence with criminal-economic policy in the light of Islamic jurisprudence and law. Materials and Methods: In the present study, the method of qualitative content analysis has been used and the information has been collected through documentary and library methods. Findings: Convergence of criminal policy and law drafting in the field of combating registration crimes requires accreditation of official documents, establishing law and order in the field of official documents, prioritizing official documents over ordinary, electronic notaries, and establishing awareness of Laws, instead of appeasement and the fact that different people are not aware of the law, is an important part of coping strategies in the field of registration. Ethical considerations: The present study is based on ethical principles, including the careful and scientific use of research resources. Conclusion: Synergy of criminal policy measures with new methods of prevention, granting the role of prevention to those in charge of criminal policy, convergence of criminal policy with preventive measures in the stages of inspection and crime detection and support of criminal policy of prevention measures based on electronic registration of new methods of prevention Are considered a crime.
