چكيده فارسي :
حق اختراع يك مخترع، از طريق ثبت اختراع ايجاد مي‌شود. اين ثبت در نظام‌هاي مختلف بر اساس يك سلسله از بررسي‌هاي شكلي و ماهوي صورت مي‌گيرد كه در كشورهاي مختلف مي‌تواند متنوع باشد. در اينجا اين پرسش مطرح است كه نظام ثبتي اختراعات مبتني بر چه فرايندي است و آثار اين فرايندهاي ثبتي چه خواهد بود؟ آيا ثبت اختراعات مانند ثبت ساير اموال است و همان نتايج را خواهد داشت؟ مقاله با روش تحليلي- توصيفي تلاش مي‌كند به بررسي وجوه تمايز بخش ثبت اختراعات از ساير اموال و نيز مطالعة شاخصه‌هاي نظام‌هاي ثبتي شكلي و ماهوي بپردازد و آثار آن را تبيين كند و سرانجام نتيجه‌گيري مي‌كند كه كشورها بر اساس سياست‌هاي خود نوع نظام ثبتي را تعيين مي‌كنند و امروزه تلاش براي اعتمادسازي به نتايج جست‌وجوي ديگر كشورها مي‌تواند به ارتقاي نظام ثبتي كمك كند. افزون بر اين، نفس ثبت اختراعات خود، موجد حق است درحالي‌كه دربارة ثبت ساير اموال ممكن است چنين نباشد.
چكيده لاتين :
The patent right of an inventor is created through the registration of an invention. The registration is taken based on a series of physical and natural investigations in different systems and can be varied in various countries. Here, the question is that the patent system is based on which process, and what can be the effects of the registration processes? Whether the patent is the same as the registration of other properties and whether can bring the same consequences or not? The study takes a descriptive-analytical method to investigate the differentiation aspects of the patent department from other properties. Besides, the study has analyzed the indicators of physical and natural patents and discriminate against the impacts. At last, the study concludes that the states determine the type of patent based on their policies. Today, making an effort to make trust in the results of the investigations of other countries can help the promotion of patent. Moreover, the nature of patent creates the right; although this is may not be true on registration of other properties.
