عقد به عنوان يكي از منابع تعهد، بيشترين كاربرد را در روابط حقوقي جامعه دارد و براين اساس تحليل و بررسي اركان و عناصر عقد داراي اهميت است. در قانون مدني عقد تعريف شده و شرايط اساسي آن در ماده 190 بيان شده است، ولي براي تحليل عناصر تشكيل دهنده عقد به عهدة حقوق‌دانان است؛ استاد جعفري لنگرودي در آثار خود تحليل درخوري در اين خصوص ارائه داده‌اند؛ بر اين اساس هدف از اين مقاله بررسي تحليل به عمل آمده استاد جعفري لنگرودي است كه با تدقيق در آرا و نظريات وي و با روش توصيفي به بررسي موضوع پرداخته شده است و نهايتاً به اين نتيجه مي‌رسيم كه خوانش جديد و بديعي از مفهوم عقد و عناصر آن را ارائه كرده است، به گونه‌اي كه با استفاده از اين نظريه ماهيت وصيت تمليكي را ايقاع و نيز ماهيت معامله فضولي را طرح عقد ناميد.

Professor Jafari Langroudi has provided appropriate analysis in this regard in his works; Accordingly, the purpose of this article is to review the analysis of Professor Jafari Langroudi, which has been studied by examining his views and theories in a descriptive manner, and finally we conclude that he has provided new and original reading of the concept of contract and Its elements . Using this theory, he called the nature of the testamentary disposition as a unilateral legal act and also the nature of the unauthorized transaction as a contract.
