Ethical Implications of Intellectual Property Rights and Iran's Membership in the World Trade Organization

يكي از نهادهاي جهاني كه نقش مهمي در قواعد و قوانين تجاري در كشورهاي مختلف جهان دارد، سازمان جهاني تجارت است. سازمان مزبور حقوق ناشي از مالكيت مادي و فكري را نيز مورد توجه قرار مي دهد و اغلب قوانين داخلي در اين زمينه، بر قوانين داخلي كشورهاي مختلف اثرگذار است. پذيرش اين قواعد از سوي كشورهاي مختلف مي تواند پيامدهاي مثبت و يا منفي داشته باشد كه هركدام از آثار مذكور، باعث اتخاذ رويكردهاي موافق و مخالف در اين زمينه مي شود. در همين راستا، پژوهش حاضر، آثار اخلاقي ناشي از رعايت و پذيرش حقوق مالكيت فكري و عضويت ايران در سازمان جهاني تجارت را مورد بررسي قرار مي دهد. بنابراين سؤال پژوهش اين است؛ آثار اخلاقي پذيرش حقوق مالكيت فكري از سوي ايران و عضويت آن در سازمان جهاني تجارت كدام است؟ در اين پژوهش با استفاده از روش توصيفي-تحليلي مشخص مي شود كه معاني و مؤلفه هاي حقوق مالكيت فكري كدام هستند؟ تاريخچه‌ي حقوق مالكيت فكري و آثار آن در كشورها و سازمان هاي مختلف جهاني به چه صورت است؟ و در نهايت اين‌كه آثار اخلاقي ناشي از پذيرش و رعايت حقوق مالكيت فكري شامل چه مواردي است؟ نتايج پژوهش نشان مي دهند كه رعايت حقوق مالكيت فكري از جنبه هاي اخلاقي باعث حمايت از علائم تجاري حقيقي و حقوقي، پذيرش رقابت سالم ميان شهروندان، توسعه‌ي علمي و اقتصادي جامعه و همچنين رعايت حقوق شهروندان مي شود.

One of the global institutions that plays an important role in trade rules and regulations in different countries of the world is the World Trade Organization. The organization also considers rights arising from material and intellectual property, and most domestic laws in this area affect the domestic laws of different countries. Acceptance of these rules by different countries can have positive or negative consequences, and each of these effects leads to the adoption of pros and cons in this field. In this regard, the present study examines the ethical implications of respecting and accepting Iran's intellectual property rights and membership in the World Trade Organization. Therefore, the research question is: What are the moral implications of Iran's acceptance of intellectual property rights and its membership in the World Trade Organization? In this research, using descriptive-analytical method, the answers to the following questions are determined: What are the meanings and components of intellectual property rights? What is the history of intellectual property rights and what are their effects in different countries and international organizations? an‎d finally, what are the moral implications of accepting and respecting intellectual property rights? The results of the research show that the observance of intellectual property rights from moral aspects helps to protect real and legal trademarks, accept healthy competition among citizens, scientific and economic development of society and also respect the rights of citizens.
