سيري در نهاد زندانباني؛ در ادوار تاريخي كهن و معاصر

A Review of the Prison Institution in Ancient and Contemporary Historical Periods

نهاد زندانباني، در ادوار تاريخي همواره با رشد جوامع و تمدن بشري در نوسان بوده است. آنچه مسلم است اين نهاد در تمدن هاي باستاني كهن نظير ايران باستان، ميان رودان (بين النهرين)، مصر باستان، آناتولي باستان و سرانجام يونان و رم باستان، به صورت هاي مختلفي وجود داشته و مورد استفاده قرار مي گرفته است. از اين رو، آنچه كه امروزه تحت عنوان نهاد زندان با رويكرد كيفري شناخته مي شود با آنچه كه در گذشته به عنوان نهاد زندان با رويكرد نگهدارنده و نه كيفري، مد نظر بوده، متفاوت است. با اين وصف، تمايز ميان كاركرد و اهداف زندان ها در قرون وسطي كه در واقع مكاني براي نگهداري بود و نه به منظور اجراي محكوميت سلب آزادي، با اهداف و مباني زندان در دنياي پيشرفته امروزي كه در واقع كاركردي سزادهنده دارد، روشن و مشخص است. بشر نخستين زندان را همچون يك بازداشتگاه براي نگهداري مي دانست و نه مجازات، از سوي ديگر، افراد در قرون وسطي، زندان را از دو جهت مد نظر قرار مي دادند؛ از يك جهت آن را مكاني براي تنبيه و بازسازي روح مي دانستند و از جهتي ديگر، مكاني براي تنبيه جسم و توبه افراد، و در نهايت امر نيز انسان مدرن، امروزه، زندان را همچون ابزاري سركوبگر و به جهت نظام بخشي و باز اجتماعي كردن افراد براي ورودي سعادتمندانه به جامعه مد نظر قرار داده است.

The institution of prisons has always fluctuated with the development of societies and human civilization in historical periods. What is certain is that this institution existed and was used in different forms in ancient civilizations such as ancient Iran, Mesopotamia, ancient Egypt, ancient Anatolia, and finally Greece and ancient Rome. Therefore, what is known today as a prison institution with a criminal approach is different from what was considered in the past as a prison institution with a custodial and not a criminal approach. With this definition, there is a difference between the function and goals of prisons in the Middle Ages, which was actually a place of detention and not for the purpose of executing the sentence of deprivation of liberty, and the goals and principles of prisons in today's advanced world, which actually has a different function than in the past. Today, the prison institution has adopted a new approach with the development of various sciences. The current research aims to explain this issue by descriptive-analytical method on authentic library sources and documents. The results indicate that with the advancement of science and the introduction of technology into human life, the institution of prison has not been exempted from this and has undergone changes. The advancement of technology has greatly helped the de-incarceration policy in Iran and the penal policies of other countries.
