بررسي وضعيت حقوقي جنگجويان خارجي از منظر حقوق بشردوستانه

Examining the legal status of foreign fighters from the perspective of humanitarian law

زمينه و هدف: اين مقاله بر جنبه هاي حقوقي مسأله جنگجويان خارجي از ديد گاه حقوق بشري و چالش هاي به وجود آمده‌از اين پديده و نگراني ها ي موجود و دسته بندي هاي منبعث از اين موضوع بين دول و در عرصه روابط بين الملل تأكيد خواهد نمود و هدف اصلي كه به‌ان اهتمام شده‌است تشريح مقررات و قوانين بشر دوستانه بين المللي در اين خصوص و در راستاي تفهيم و تبيين اقدامات جنگجويان خارجي و تعديل و تخفيف و مديريت و كنترل مضار و عواقب ناخوشايند اين پديده در حد مطلوب و با آناليزكردن چالش هاي به وجود آمده مي باشد. روش شناسي: پژوهش حاضر با روش توصيفي و تحليلي انجام شده‌است. يافته ها و نتايج: در تحقيق حاضر با بررسي پديده جنگجويان خارجي كه هم اينك با از ميان رفتن مرزهاي بين المللي توسط گزاره هايي چون ايدئولوژي و منافع شخصي، يكي از مهمترين دغدغه هاي كشورهاي دنيا شده‌است، به منابع حقوقي عليه‌اين واقعيت به‌انضمام منابع و قلمرو حقوق بشردوستانه ناظر بر پديده جنگجويان خارجي پرداخته شده‌است. در پايان حدود انطباق قوانين و مقررات بين المللي موجود ناظر بر مقوله جنگجويان خارجي، با حقوق بشر دوستانه بررسي و مطالعه گرديد كه نتيجه گرفته شد قوانين و مقررات بين المللي موجود در رابطه با مقوله جنگجويان خارجي با حقوق بشردوستانه تا حدود زيادي منطبق است.

Background and Aim: This article will emphasize the legal aspects of the issue of foreign fighters from a human rights perspective and the challenges that have arisen from this phenomenon and the existing concerns and categories arising from this issue between states and in the field of international relations. an‎d the main purpose of this is to explain the international humanitarian rules and regulations in this regard and in order to understand and explain the actions of foreign fighters and to mitigate, mitigate, manage and control the harms and unpleasant consequences of this phenomenon to the desired level and by analyzing the challenges. Has come into being. Methodology: The present study was conducted by descriptive and analytical methods.
