چالش هاي ناشي ازعدم تحديد‌حدود فضاي ماوراء جو بر امنيت ملي و حاكميت دولتها

The challenges posed by the non-delimitation of outer-space on national security and states sovereignty

با پرتاب اولين قمر مصنوعي به فضا و استقرار نخستين ماهواره در مدار زمين، مساله محدوده و گستره حاكميت كشورها در حريم هوايي و فضاي ماوراء جو به يكي از چالش‌هاي مهم حقوقي تبديل شد. با شروع عصر فضا مجادله و چالش بر سر تعيين مرز ميان حريم هوايي كه حاكميت مطلق دولتها در آن جاري است، و قلمرو فضايي كه ادعاي حق حاكميت برآن ممنوع گرديده آغاز شد. اين پژوهش به دنبال پاسخ به اين پرسش است كه چه نظرات و رويه‌هايي درخصوص قلمرو فضاي ماوراء جو وجود دارد؟ عدم تحديد حدود فضا چه چالش‌هايي بر امنيت ملي و حاكميت دولتها ايجاد مي‌كند؟ نتايج تحقيق كه با روش تحليلي- توصيفي انجام شده نشان مي‌دهد عدم تعيين مرز ميان هوا و فضاي ماوراء چالش‌هاي متعددي همچون ايجاد ابهام در تعيين مسئوليت دولتها در حريم هوايي و قلمرو فضايي، محروميت كشورهاي درحال توسعه را از حق دسترسي آزاد به فضا، مجادله برسر حق عبور بي ضرر در قلمرو هوايي، بحث حق دفاع از خود در مقابل پايش زميني و سنجشي ماهواره‌هاي نظامي و استقرار تسليحات فضاپايه در ارتفاعات زيرمداري را مطرح سازد. محقق در اين پژوهش با احصاء اين چالش‌ها، رهيافت‌هاي مناسبي را براي ارتقا امنيت ملي پيشنهاد نموده است.

With the launch of the first artificial satellite into outer space and the deployment of the first satellite in Earth’ orbit, the issue of the extent of sovereignty in the atmosphere and outer space has become one of the major legal challenges. Since the beginning of the space age, legal disputes begin over the delimitation of the airspace over which the absolute sovereignty of states is established, and Outer space domain, in which has not subject to national appropriation or claim of sovereignty accepted. This research seeks to answer the question of which Theories and thoughts exist on the realm of outer space, and what are its challenges to national security and state sovereignty? The results of this descriptive-analytical research show that the lack of delineation of the boundary between airspace and outer space poses numerous challenges such as: uncertainty in the states’ responsibility in airspace and outer space, deprivation of developing countries to outer space free access, ambiguity in self-defense against the deployment of military and ground monitoring satellites, and deployment of weapons in outer space sub-orbital altitudes. To address these challenges, the researcher has suggested appropriate approaches.
