آميختگي فقه و اخلاق در گزاره‌هاي فقهي باب معاملات‌

The fusion of jurisprudence and ethics in the jurisprudential propositions of transactions

به رغم اين‌كه مسائل فقهي باب معاملات عرصه‌هاي پيگيري اغراض عقلايي در سطح معيشت و به منظور تأمين منافع مالي فردي و اجتماعي‌اند و در نگاه نخست، گمان مي‌رود كه همه چيز تابعي از منافع و مصالح تجاري آدميان است و تنها قيد محدود‌كنندۀ گزاره‌هاي حقوقي اين باب، اصل تعادل و توازن در معاوضات است، اما با ژرف‌نگري در اين موضوع، زمينه‌هاي وسيعي از آميختگي فقه و اخلاق در اين حيطه مي‌توان يافت. در اين مقاله به روش توصيفي۔ تحليلي و با تعمّق و تدبّر در اصول اخلاقي و احكام فقهي معاملات گونه‌هاي متعددي از تأثيرگذاري اخلاق در فقه را برجسته شده و مجموعه‌اي از احكام معاملات كه برخوردار از جنبه اخلاقي هستند شناسايي و دسته‌بندي شده است و از اين رهگذر، تلاش شده تا با ارائۀ تصويري جامع و منسجم از گزاره‌هاي حقوقي فقه، شبهۀ مغايرت فقه و اخلاق نيز زدوده شود.

Although jurisprudential issues in the field of transactions are areas of pursuit of rational intentions at the level of livelihood and in order to provide individual and social financial benefits, at first glance it is thought that everything is a function of human commercial interests and only the limitation of legal propositions Chapter is the principle of balance in exchanges, but with a deep look at the subject, a wide range of jurisprudence and ethics can be found in this area. The present research intends to be descriptive-analytical method, and has been collected using library and Internet resources. By pondering on the moral principles and rules of jurisprudence, transactions will find various types of moral influence in jurisprudence and identify and categorize a set of rules of transactions that have a moral aspect, and through this, provide a delicate picture of the legal propositions of jurisprudence. an‎d remove the suspicion of the contradiction between jurisprudence and ethics.
