ولايت فقيه و ظرفيت اثبات آن در توقيع شريف ولي‌عصر (عج)

در نوشتار پيش رو مسئله ولايت فقيه و ظرفيت اثبات آن در توقيع شريف امام عصر؟عج؟ به اسحاق بن يعقوب ره بررسي شده است. با واكاوي اجزا و عناصر توقيع شريف، و استفاده از گفتار فقها پيرامون توقيع شريف با فرضيه‌هايي چند روبرو مي‌شويم: 1. ولايت مطلقه فقيه؛ 2. ولايت در امور سياسي و اجتماعي؛ 3. ولايت بر فتوا و احكام شرعي؛ 4. ولايت بر قضاء و رفع منازعات و مرافعات؛ 5. ولايت بر فتوا در امور متجدده و مسائل مستحدثه؛ 6. ولايت بر فتوا در مسائل غير مورد ابتلاء؛ 7. ولايت در تشخيص علائم ظهور امام مهدي ع. ما با بررسي سندي و واكاوي دلالي فقرات توقيع به صورت مجزا، احتمال اول را تقويت كرده و دلالت توقيع شريف بر ولايت مطلقه فقيه را تمام مي‌دانيم. پژوهش حاضر در تحصيل يافته‌هاي خود از روش گردآوري داده‌ها به صورت كتابخانه‌اي، و روش تحقيق از گونه توصيفي _ تحليلي بهره برده است.

In the present article, the issue of Velayat-e-Faqih and the capacity of proving it in the honorable signature of Imam al-Asr to Ishaq ibn Ya'qub has been studied. By analyzing the components and elements of honorable signature, and using the words of the jurists about honorable signature, we come across several hypotheses; 1: Absolute guardianship of the jurist. 2: Guardianship in political and social affairs. 3: Guardianship over fatwas and religious rules. 4: Provincial jurisdiction and resolution of disputes and litigation. 5: Guardianship over fatwas in modern matters and new issues. 6: Province on fatwas in matters not affected. 7: Province in recognizing the signs of the advent of Imam Mahdi (as). By examining the components of signature separately, we strengthen the first possibility and complete the implication of honorable signature on Velayat-e-Faqih. The present study has used the method of data collection in a library, and the research method has been descriptive-analytical.
