چكيده فارسي :
گردشگري مذهبي، مبتني بر مجموعه اي از قواعد و انگاره هاي حقوقي است كه به رغم اهميت، كمتر به بحث و گفت و گو واگذار شده و مجموعه اي منضبط و احصا شده ندارد. از همينرو مسئله و ضرورت اين نوشته را ميتوان در تحليل و استقراي حقوق سالمندان به مثابه زائران بقيع دانست؛ بخصوص كه گاه سالمندان، انبوه عظيمي از زائران بقيع را شكل ميدهند. در اين نوشته، سالمندي، بيش از آنكه عارضه اي شخصي و بيولوژيك قلمداد شود، وضعيتي آسيبپذير در فرآيند زيارت مطرح ميشود كه نيازمند درج حقوقي ويژه نسبت به سالمندان و تكاليفي بر عهده دولتهاي زائرفرست، دولت عربستان و زائران است.
نوشته توصيفي-تحليلي پيش رو، به اين نتيجه دست مي يازد كه سالمند، مبتني بر ادله اي چون مصلحت و كرامت و نيز اصل برابري و منع تبعيض، از حق زيارت برخوردار است. همچنين در اين نظم حقوقي، حق سلامت، تبعيض مثبت، تسهيل در دسترسي، تخفيف و حريم خصوصي، انگاره هايي است كه بايد مد نظر دولت ميزبان زائر سالمند (عربستان)، و نيز مواردي چون اولويت در تخصيص منابع دولتهاي فرستنده مد نظر دولت فرستنده زائر سالمند قرار گيرد.

Religious tourism is based on a set of legal rules and ideas. Despite its importance, religious tourism is less discussed and does not have a disciplined collection. Therefore, the statement of the problem and the necessity of doing this research can be considered in the analysis and induction of the rights of the elderly as pilgrims to , especially since the elderly sometimes form a large number of pilgrims to . In this article, aging is considered as a vulnerable situation in pilgrimage process, rather than being thought as a personal problem or a biological disorder, which requires the inclusion of special rights for the elderly and assigning tasks to the states dispatching pilgrims, the Saudi government, and pilgrims. This descriptive-analytical article concludes that the elderly have the right to pilgrimage based on arguments such as expediency and dignity, as well as the principles of equality and non-discrimination. Also, in this legal system, the right to health, positive discrimination, facilitating access, relaxation, and privacy are the issues that the host government of the elderly pilgrims (Saudi Arabia) should take care of. In addition, the governments that dispatch the elderly pilgrims should consider issues such as priority in allocating resources.
