چكيده فارسي :
اﻧﺪﯾﺸﻪ ﺣﮑﻤﺮاﻧﯽ ﺧﻮب ﺑﻪ ﻋﻨﻮان ﯾﮑﯽ از ﻣﺒﺎﺣﺚ ﭘﺮﺗﻨﺶ در دﻫﻪ ﻫﺎي اﺧﯿﺮ در ﻋﺮﺻﻪ ﺑﯿﻦ اﻟﻤﻠﻠﯽ ﻣﻄﺮح ﺷﺪه اﺳﺖ. ﺑﻪ ﻫﻤﯿﻦ دﻟﯿﻞ، ﻣﻘﺎﻟﻪ ﺣﺎﺿﺮ ﺑﺎ روﯾﮑﺮد ﺗﻮﺻﯿﻔﯽ ـ ﺗﺤﻠﯿﻠﯽ، ﻇﺮﻓﯿﺖ ﻫﺎي ﻗﺎﻧﻮن اﺳﺎﺳﯽ ﺟﻤﻬﻮري اﺳﻼﻣﯽ اﯾﺮان در ﺗﺤﻘﻖ ﺣﮑﻤﺮاﻧﯽ ﺧﻮب، ﺑﺎ ﺗﺄﮐﯿﺪ ﺑﺮ ﻧﻈﺎرت را ﻣﻮرد ﺑﺤﺚ و ﺑﺮرﺳﯽ ﻗﺮار داده اﺳﺖ. ﺑﺪﯾﻬﯽ اﺳﺖ ﻧﺘﯿﺠﻪ ﺑﺤﺚ ﺑﯿﺎﻧﮕﺮ آن اﺳﺖ ﮐﻪ ﻣﺆﻟﻔﮥ ﻧﻈﺎرت، ﺑﻪ ﻋﻨﻮان ﺟﺰء ﺟﺪاﯾﯽ ﻧﺎﭘﺬﯾﺮ ﻫﺮ ﺣﮑﻮﻣﺖ ﻣﻄﻠﻮب ﻣﻮرد ﺷﻨﺎﺳﺎﯾﯽ واﻗﻊ ﺷﺪه اﺳﺖ. ﻟﺬا ﻻزم اﺳﺖ ﺗﺎ ﺑﻪ ﺗﺤﻘﻖ اﯾﺪه ﺣﮑﻤﺮاﻧﯽ ﺧﻮب از ﻣﻨﻈﺮ اﯾﻦ ﻋﻨﺼﺮ ﻣﻬﻢ و اﺳﺎﺳﯽ ﻧﮕﺮﯾﺴﺘﻪ ﺷﻮد. در ﮐﺸﻮر اﯾﺮان ﻧﯿﺰ ﺑﻪ ﻧﻈﺎم ﻧﻈﺎرت ﺗﻮﺟﻪ ﮐﺎﻓﯽ ﻣﺒﺬول ﺷﺪه و ﺳﺎزوﮐﺎرﻫﺎﯾﯽ ﺑﺮاي ﮐﺎرآﻣﺪي ﻫﺮ ﭼﻪ ﺑﻬﺘﺮ اﯾﻦ ﻧﻈﺎم در ﻗﻮاﻧﯿﻦ ﭘﯿﺶﺑﯿﻨﯽ و ﺗﻌﺒﯿﻪ ﺷﺪه اﺳﺖ. اﯾﻦ ﭘﮋوﻫﺶ در ﭘﯽ آن اﺳﺖ ﮐﻪ اﺛﺒﺎت ﻧﻤﺎﯾﺪ ﮔﺮﭼﻪ ﻣﺆﻟﻔﻪ ﻫﺎي اﯾﺪه ﺣﮑﻤﺮاﻧﯽ ﺧﻮب در ﻧﻈﺎم ﺗﻘﻨﯿﻨﯽ اﯾﺮان ﻣﻮرد ﺗﻮﺟﻪ واﻗﻊ ﺷﺪه، اﻣﺎ اﯾﻦ اﯾﺪه ﺑﻪ ﻣﻔﻬﻮم واﻗﻌﯽ آن در اﯾﻦ ﮐﺸﻮر ﺟﺮﯾﺎن ﻧﺪاﺷﺘﻪ اﺳﺖ و ﺿﺮورت دارد ﮐﻪ در ﺟﻬﺖ ﺑﻬﺮهﺑﺮداري از اﯾﻦ ﻣﻘﻮﻟﻪ ﻣﻬﻢ در ﻧﻈﺎم ﻗﺎﻧﻮنﮔﺬاري و ﺳﯿﺎﺳﺖﮔﺬاري ﺗﻮﺟﻪ ﺷﻮد. دﺳﺖﯾﺎﺑﯽ ﺑﻪ اﯾﻦ ﻧﺘﯿﺠﻪ ﻣﻔﯿﺪ ﻓﺎﯾﺪه اﺳﺖ ﮐﻪ دﺳﺖ ﺣﮑﻤﺮاﻧﯽ ﺧﻮب آن ﭼﻨﺎن ﮐﻪ در ﻗﺎﻧﻮن اﺳﺎﺳﯽ اﯾﺮان ﺗﺒﯿﯿﻦ ﮔﺮدﯾﺪه اﺳﺖ، ﺑﺎﯾﺪ ﺑﺎ ﻟﺤﺎظ ﺑﻌﺪ ﻧﻈﺎرﺗﯽ در ﻗﻮاﻧﯿﻦ ﭘﺎﯾﯿﻦدﺳﺘﯽ ﻧﯿﺰ ﺗﺪوﯾﻦ و اﺟﺮا ﺷﻮد ﺗﺎ اﻫﺪاف ﻗﺎﻧﻮن اﺳﺎﺳﯽ محقق ﮔﺮدد.
چكيده لاتين :
The idea of good governance has been raised as one of the most challenging topics in recent decades in the international arena, for this reason, this article, with a descriptive-analytical approach, discusses and examines the capacities of the constitution in realizing good governance with an emphasis on supervision, and the result The discussion shows that: the element of supervision is an integral part of any good government and therefore it is necessary to look at the realization of the idea of good governance from the perspective of this important and fundamental element. In our country, sufficient attention has been paid to the monitoring system, and mechanisms for the better efficiency of this system have been embedded in the laws.However, although the components of the idea of good governance in the legal system of Iran have been noticed, this idea in its true sense as defined by its designers does not flow in our country, and it is necessary to explore and exploit this important category in the legal system. Setting and policy making and implementation of the matter benefited enough.
