وجود رژيم منع گسترش سلاح هاي هسته اي در جهان دولتها را بر آن داشت تا حقوق هسته اي خود را در قالبي معين پيگيري نمايند تا تضميني باشد بر حفظ صلح و امنيت بين المللي و به علاوه منافع ملي هر دولت در خصوص حقوق هسته اي نيز تامين گردد. بر اين اساس حقوق و تعهدات هسته اي ايران نيز تحت اسناد موجد حقوق هسته اي و اسناد محدود كننده آن شكل گرفت. در اين ميان به دنبال اختلافاتي كه ميان ايران و آژانس بين المللي انرژي اتمي رخ داد، ايران تحت تحريم هاي مختلف، قرار گرفت و البته دو نهاد بين المللي يعني شوراي امنيت و آژانس بين المللي انرژي اتمي نقش تعيين كننده اي را ايفاء نمودند. بر اين مبناء به دنبال بررسي اين امر هستيم كه آيا اقدامات اين دو نهاد بين المللي در ارتباط با پرونده هسته اي ايران در قلمرو حقوق بين الملل بوده است؟ در بررسي اقدامات شوراي امنيت و آژانس بين المللي انرژي اتمي در برخورد با پرونده اتمي ايران ملاحظه مي گردد كه نه تنها ملاحظات فني و تخصصي ملاك برخورد نبوده بلكه ملاحظات سياسي موجب امنيتي شدن پرونده ايران و اعمال فشار حداكثري براي تعطيلي صنعت هسته اي و محدود كردن صنعت موشكي ايران بوده است. همچنين اقدامات آژانس مطابق اساسنامه خود نبوده و شوراي امنيت نيز بدون توجه به گزارش هاي آژانس، موضوع هسته اي ايران را تهديدي عليه صلح و امنيت بين المللي اعلام نموده تا موجبي براي اعمال تحريم عليه ايران باشد.
