چكيده فارسي :
پليس، در نظام هاي سياسي و حقوقي، يكي از مهم ترين نهادهاي حاكميت عمومي از سوي قدرت حاكم بر جامعه است. امروزه، پليس به صورت رسمي و بر اساس صلاحيت هاي مشخص، ابزار حكومت ها براي تأمين و تضمين امنيت پايدار در جامعه و مقابله با جرائم و ناهنجاري هاي رفتاري است. اين امر، رسالت هاي مهمي بر عهده نهاد پليس مي گذارد. در فقه سنتي اسلامي، با واژه پليس روبرو نيستيم و اساساً نهاد پليسي گري، از ابداعات حقوق عرفي غربي است ولي با اين حال، در فقه، با نهادي روبرو هستيم كه حسبه نام دارد كه در فقه سنتي اسلامي، ابزار و سازوكاري در دست حاكميت به منظور نظارت بر رفتارها، هدايت رفتارها و جلوگيري از انحرافات رفتاري بوده است.از سوي ديگر، امروزه، حوزه فعاليت ها و صلاحيت هاي نهاد پليس، به وضوح با قلمرو حقوق شهروندي افراد در ارتباط تنگاتنگ قرار مي گيرد به نحوي كه هر عملكرد خلاف قاعده و معارض با استانداردهاي حرفه اي و قوانين و مقررات مصوب در زمينه اقدام پليس، مي تواند به راحتي، نقض حقوق شهروندي را به دنبال داشته باشد. در اين نوشتار، سعي شده است ضمن بررسي تعريف پليس در حقوق عرفي، نهاد حسبه در فقه سنتي اسلامي و يكسان انگاري آن با نهاد پليس در حقوق عرفي امروز، بررسي شود. همچنين كاركرد نهاد پليس در صيانت از حقوق شهروندي مورد بررسي قرار گرفته است. نوع اين تحقيق، بنيادي و رويكرد آن، توصيفي- تحليلي، روش انجام آن، مطالعه كتابخانه اي و ابزار گردآوري اطلاعات در آن، فيش برداري است.

Today, the police are formally, based on specific competencies, the tools of governments to ensure and ensure lasting security in society and to combat crime and behavioral disorders. This imposes important missions on the police. In traditional Islamic jurisprudence, we do not encounter the word police and basically the institution of policing is one of the innovations of Western customary law. In order to monitor behaviors, direct behaviors and prevent behavioral deviations. On the other hand, today, the scope of activities and competencies of the police institution is clearly linked to the realm of individual citizenship rights in such a way that any wrongdoing Rules and conflicts with professional standards and laws and regulations adopted in the field of police action, can easily lead to violations of civil rights. In this article, while examining the definition of police in customary law, the institution of Hasbeh in traditional Islamic jurisprudence and its similarity with the police institution in customary law today is examined. The function of the police in protecting civil rights has also been examined. The type of this research is fundamental and its approach is descriptive-analytical, its method is library study and the data collection tool in it is taking notes.
