بررسي حمايت از زنان قرباني خشونت خانگي در حقوق ايران و اسناد بين‌الملل

A Study of the Protection of Women Victims of Domestic Violence in Iranian Law and International Documents

خشونت عليه زنان يكي از پديده­هاي اجتماعي رايج در جوامع انساني و خشونت خانگي رايج­ترين شكل خشونت عليه زنان است. اين معضل اگر زماني امري خصوصي محسوب مي­شده اما امروزه با توجه به پيامدهاي آشكار و نهان آن بر خانواده و اجتماع، مورد توجه و حساسيت دولت­ها، نهادها و سازمان­هاي مربوطه قرار گرفته است. در اين ميان لازم است سهم قوانين در كاهش يا افزايش اين پديده مشخص شود. هدف از اين تحقيق بررسي حمايت از زنان قرباني خشونت خانگي در حقوق ايران و اسناد بين­ الملل مي­باشد. در اين تحقيق از روش توصيفي - تحليلي و با استفاده از روش كتابخانه­ اي به گردآوري اطلاعات پرداخته شده است. نتايج نشان دهنده اين است كه مطالعات انجام گرفته در خصوص ميزان و مصاديق خشونت عليه زنان در خانواده حكايت از شيوع اين رفتارها دارد. اين رواج ناموزون‌ مي‌تواند آسيب‌هاي گاه جبران ناپذير و البته پايدار نسبت به زنان و ساير آحاد جامعه در پي داشته باشد. پيشگيري از بروز اين اعمال از يك سو و مبارزه با آن از سوي ديگر مستلزم توجه به زواياي گوناگون موضوع‌ مي‌باشد كه مطالعه در هريك از اين موارد نيازمند همت صاحب ­نظران و متخصصين حوزه‌هاي مربوطه است. بررسي قانوني مسئله نيز يكي از ابعادي است كه خود بايد در حوزه‌هاي مختلف كيفري، مدني و آيين دادرسي انجام پذيرد. در اين ميان بررسي سياست جنايي و كيفري ايران و رويكردهاي اتخاذي در اين زمينه، به ويژه براي پيشگيري از بزه ديدگي اوليه و ثانويه بسيار موثر خواهد بود.

Violence against women is one of the most common social phenomena in human societies and domestic violence is the most common form of violence against women. This problem was once considered a private matter, but today, due to its obvious and hidden consequences on the family and society, it has been considered and sensitive by governments, institutions and relevant organizations. In the meantime, it is necessary to determine the role of laws in reducing or increasing this phenomenon. The purpose of this study is to investigate the protection of women victims of domestic violence in Iranian law and international documents. In this research, descriptive-analytical method has been collected using the library method. The results show that studies on the extent and cases of violence against women in the family indicate the prevalence of these behaviors. This unbalanced practice can lead to sometimes irreparable and, of course, lasting harm to women and other members of society. Preventing the occurrence of these acts on the one hand and combating them on the other requires attention to various aspects of the subject, and the study of each of these cases requires the efforts of experts and specialists in the relevant fields. Legal examination of the issue is also one of the dimensions that should be done in various areas of criminal, civil and procedural. In the meantime, the study of Iran's criminal and penal policy and the approaches adopted in this field will be very effective, especially for the prevention of primary and secondary victims.
