چكيده فارسي :
جامعه مدني از جمله واژه‌هايي است كه گرچه تغييرات فراواني را در گذر زمان به خود ديده است، اما قدمتي به طول تاريخ حيات بشري دارد. زيرا افراد جامعه در كنار يكديگر زندگي مي‌كنند و براي ايجاد يك نظم اجتماعي به ناچار وظايفي بر عهده مي‌گيرند، كه موجب استحقاق حقوقي براي ايشان مي‌گردد. گرچه برخي انديشمندان براي جامعه هم وجود اعتباري قائل هستند يكي از موضوعات مورد توجه انديشمندان و صاحبان مكاتب حقوقي مختلف جهان در حال حاضر بحث در مورد حقوق شهروندي مي باشد؛ كه توجه به تعاليم اديان الهي، نقش مؤثر آنها را در شكل دهي و ترويج حقوق افراد در يك كشور و حقوق شهروند روشن مي نمايد، زيرا خاستگاه افراد در يك كشور و شهروند، فطرت انسان است، خالق اين فطرت بهتر و بيشتر از هر مرجع ديگري از آفريده خود اطلاع دارد. فطرتي كه انسان براي دستيابي به آن بايد از هر گونه خودخواهي عبور كند. از اين رو حقوق اسلامي با ديگر حقوق وضع شده از سوي انسان ها اختلاف مبنايي دارد. در اين مقاله حقوق افراد جامعه، كه آن را حقوق شهروند ناميده اند، از منظر فقه اسلام مورد بررسي قرار گرفته است؛ كه ضمن ذكر مفهوم حقوق شهروندي و برخي از موارد آن در فقه اسلام به مباني فقهي اين حقوق نيز اشاره شده است ؛ كه روشن مي شود اسلام تنها يك دين اعتقادي نيست و دستورات آن در عبادات خلاصه نمي شود، بلكه احكام بسياري در زمينه حقوق از جمله حقوق شهروندي و صيانت از حقوق افراد در يك كشور و ضمانت اجراي آن دارد.

Civil society is one of the words that, although it has seen many changes over time, it is as old as the history of human life. Because the members of the society live together and in order to create a social order, they inevitably take on duties, which gives them legal rights. Although some thinkers believe that society has a valid existence, one of the topics that thinkers and owners of different legal schools in the world are currently discussing is the discussion about citizenship rights; Paying attention to the teachings of divine religions makes clear their effective role in shaping and promoting the rights of individuals in a country and the rights of citizens, because the origin of individuals in a country and citizen is human nature, the creator of this nature is better and more than any authority. The other knows about his creation. A nature that man must overcome any selfishness to achieve. Therefore, Islamic law has a fundamental difference with other laws established by humans. In this article, the rights of people in society, which are called citizen rights, have been examined from the perspective of Islamic jurisprudence; In addition to mentioning the concept of citizenship rights and some of its cases in Islamic jurisprudence, the jurisprudential foundations of these rights are also mentioned; It becomes clear that Islam is not only a religious belief and its orders are not limited to worship, but it has many rules in the field of rights, including citizenship rights and the protection of the rights of individuals in a country and guarantees its implementation.
