Investigation of Deterrence of the Law on Handling Traffic Violations in Accident Prevention

زمينه و هدف: با بررسي آمارهاي رسمي اعلام شده، كاهش­ تعداد كشته ­هاي حوادث رانندگي در سال هاي 1390 تا1390، نشان از بازدارندگي قانون رسيدگي به تخلفات رانندگي در كاهش حوادث ترافيكي كشور داشته ولي از سال 1396 به­ بعد شاهد افزايش تعداد مجروحين و متوفيان حوادث رانندگي هستيم. بررسي­ هاي علمي انجام شده در سال ­هاي اخير پيرامون علل افزايش حوادث ترافيكي نشان مي ­دهد كه يكي از عوامل افزايش تصادفات رانندگي كاهش بازدارندگي قانون مذكور بوده است. لذا هدف­ اين پژوهش، بررسي بازدارندگي قانون رسيدگي به­ تخلفات رانندگي در پيشگيري از تصادفات است. روش: اين تحقيق از نظر هدف، كاربردي و از نظر روش، آميخته از نوع تشريحي بود. جامعه آماري، بخش ­كيفي خبرگان پليس­ راهور و بخش­ كمّي مديران مناطق 28 گانه راهور تهران­ بزرگ به تعداد 112 نفر مي ­باشند. نمونه ­گيري در بخش كيفي به روش هدفمند و در بخش­ كمّي به روش طبقه ­اي بود. به منظور تجزيه و تحليل داده­ هاي گردآوري شده­ در بخش كيفي (مصاحبه) از روش تحليل تم با استفاده از نرم افزار MAXQDA و در بخش ­كمّي از تحليل عاملي تأييدي و براي اعتبارسنجي مدل حاصل از بخش كيفي به روش مدل­ يابي ­معادلات ساختاري با استفاده از نرم افزار LISREL8.5 انجام شد. يافته ­ها: يافته­ هاي بخش كيفي، بازدارندگي­ هاي قانوني، اجرايي و سياست­ گذاري مشخص گرديد كه در بخش كمّي نيز مورد تأييد قرارگرفت. مهم­ترين چالش ­ها شامل خلأهاي قانوني، نياز به به­ روزرساني و عدم وجود ضمانت اجرا در برخي از مواد قانون، نبود سازمان راهبر، ضعف در اجراي قانون و نبود مدل مفهومي پيشگيري از تصادفات بودند. نتيجه­ گيري: نتايج حاصل از پژوهش نشان مي ­دهد كه قانون رسيدگي به تخلفات رانندگي بازدارندگي لازم را در پيشگيري از تصادفات نداشته و لازم است بازنگري در قانون مذكور انجام شود تا با نگاه راهبردي و مديريت واحد بتوان زمينه را براي پيشگيري از تصادفات، محقق كرد.

Background and Objective: According to the official statistics, the decrease in number of fatalities in traffic accidents of 2011-2016 shows the deterrence of the law handling traffic violations reducing traffic accidents in the country, but since 2017, the number of injured and dead in traffic accidents has increased. Scientific studies conducted in recent years on the causes of the increase in traffic accidents show that one of the factors in the increase in traffic accidents has been the reduction of deterrence of the law. Therefore, the purpose of this study is to investigate the deterrence law on investigating traffic violations in the prevention of accidents. Method: This research was applied in terms of purpose and descriptive in terms of mixed method. The statistical population is the qualitative section of IRI Traffic Police experts and the quantity section of managers of the 28 districts of Tehran traffic police with a large number of 112 people. Sampling was qualitative in targeted method and stratified in the quantitative part. In order to analyze the data collected in the qualitative part (interview) of the theme analysis method using MAXQDA software and in a quantity part of the confirmatory factor analysis and to validate the model obtained from the qualitative part by modeling, structural equation was done using LISREL8.5 software. Findings: The findings of the qualitative section, legal, executive and policy constraints were identified, which were also confirmed in the quantitative section. The most important challenges included legal loopholes, the need for updates and the lack of enforcement guarantees in some articles of the law, the lack of a governing body, weaknesses in law enforcement, and the lack of a conceptual model for accident prevention. Results: The results of the study show that the law on the investigation of traffic violations does not have the necessary deterrence in the prevention of accidents and it is necessary to review the law to achieve a strategic perspective and management to prevent accidents.
