مباني شفافيت قانون‌گذاري از ديدگاه قرآن، روايات و حكمراني خوب

Fundamentals of legislative transparency from the Qur'an, narrations and good governance perspective

شفافيت، به‌معني آشكار بودن و در دسترس بودن اطلاعات جهت بررسي و نظارت، از موضوعات محوري در حكومت‌داري، تصميم‌گيري و وضع قوانين است. در انديشه‌ي سياسي اسلام، مردم‌سالاري ديني بر آراي خام و ناآگاهانه‌ي مردم استوار نيست، بلكه جوهر آنرا آگاهي مردم شكل مي‌دهد و وظيفه‌ي حاكم اسلامي به‌عنوان امانتدار مردم اين است كه مسائل جامعه را به‌گونه‌اي شفاف و صادقانه با مردم درميان گذارد. شفافيت در حكومت‌هاي مردم‌سالار به‌قدري اهميت دارد كه دسترسي آزادانه به اطلاعات و علني بودن آن شرط اول مقابله با فساد و پاسخگويي مقامات به‌حساب مي‌آيد. در اين تحقيق به‌دنبال شناخت رويكرد اسلام به مقوله‌ي شفافيت هستيم؛ و بدين نتيجه رسيديم كه شفافيت حكومت اسلامي جزو مقوله‌‌هاي مورد توجه در آموزه‌‌هاي ديني است؛ به‌نحوي كه سنت و سيره‌ي معصومين نيز بر آن صحه گذاشته و آثار متعدد آن در جاي‌جاي دين مورد تأكيد قرار گرفته است. همچنين هم در مولفه‌هاي حاكم بر نظريه حكمراني خوب و هم در تاكيدات قرآن و روايات، شاخص شفافيت از ملزومات حكومت‌داري و تشريع قوانين لازم براي اداره جامعه به شمار مي‌آيد.

Transparency, which means the openness and availability of information for survey and monitoring, is a central issue in governance, decision making and rule making. From the point of view of Islamic political thought, religious democracy is not based on the raw and unconscious opinions of the people, but its essence is formed by the awareness of the people; an‎d the duty of the Islamic ruler as the trustee of the people is to discuss the issues of the society in a transparent and honest way with the people. Transparency is a very important issue in democracies, to the extent that free access to information and its publicity is the first condition for combating corruption and holding officials accountable. In this study, we seek to understand the approach of Islam to the category of transparency; an‎d we came to the conclusion that the transparency of the Islamic government is one of the categories considered in religious Doctrines; In a way that the tradition and manners of the infallibles have been confirmed and its multiple bases and function has been emphasized everywhere in Islam. Also, the transparency index is a requirement of governance and legislation for society management in both views of good governance theory components and Qur'an and hadiths emphasis.
