اصول كلامي حاكم بر تشريع مجازات‌ در اسلام

Proof of the existence of Imam Asr (AS) in the light of occult traditions

نظام‌مند كردن گزاره‌هاي ديني ناظر به تشريع مجازات‌هاي اسلامي، نقش عمده‌اي در درك همه جانبه فلسفه تشريع آنها و پاسخ‌ به شبهات مخالفان دارد. نتيجه اين كار، استخراج بايدها و نبايدهايي مبتني بر عقايد ديني است كه بر تشريع مجازات‌هاي اسلامي حاكم‌‌اند. اين بايدها و نبايدها، اصول كلامي حاكم بر تشريع مجازات‌ خوانده مي‌شوند. اين مقاله درصدد است با روش توصيفي ـ تحليلي و با مفروض گرفتن ساحت‌هاي وجودي انسان و مسير تكاملي او در انسان‌شناسي اسلامي، ضمن نظام‌مند كردن گزاره‌هاي ديني ناظر به تشريع مجازات‌ در اسلام، اصول كلامي‌اي را استخراج كند كه با بكارگيري صحيح آنها، فلسفه تشريع مجازات‌هاي اسلامي به‌خوبي روشن گردد. بر اساس يافته‌هاي اين پژوهش، اصول مستخرج از متون ديني عبارتند از: 1. اصل كرامت ذاتي انسان؛ 2. اصل هدايت‌گري و رستگاري؛ 3. اصل عدالت‌طلبي و احقاق حق؛ 4. اصل حيات و پويايي فرد و جامعه؛ 5. اصل بازدارندگي در مجازات. بعد از تبيين اين اصول و بيان تقدم يا تأخر آنها نسبت به يكديگر، به نقش آنها در پاسخ به شبهات كلامي وارد بر مجازات‌هاي اسلامي اشاره شده است.

Systematizing the religious propositions related to the legislation of Islamic punishments plays a major role in comprehensively understanding the philosophy of their legislation and answering the doubts of the opponents. The result of this work is the extraction of dos and don'ts based on religious beliefs that govern the legislation of Islamic punishments. These dos and don'ts are called theological principles governing the legislation of punishment. This article tries to use the descriptive-analytical method and by assuming the existential fields of man and his evolutionary path in Islamic anthropology, while systematizing the religious propositions related to the legislation of punishment in Islam, to extract theological principles that with their correct application, the philosophy of the legislation of punishments Islam should be well explained. Based on the findings of this research, the principles extracted from religious texts are: 1. the principle of inherent human dignity; 2. the principle of guidance and salvation; 3. The principle of justice and justice; 4. The principle of life and dynamism of the individual and society; 5. The principle of deterrence in punishment. After explaining these principles and stating their priority or delay relative to each other, their role in answering the theological doubts about Islamic punishments has been pointed out.
