ARMS CONTROL AND DISARMAMENT IN THE UN CHARTER LAW: THEOY AND PRACTICE

The Charter of the United Nations refers to certain purposes and principles to save succeeding generations from the scorage of war. In theory, disarmament would be a mean to achieve them in particular, maintenance of international peace and security. Moreover, in accordance with the Charter, General Assembly may consider principles governing disarmament and the regulations of armaments. In practice, the Security Council, as an organ primarily responsible for maintenance of peace and security, has taken several and different measures inter alias establishment of subsidiary organs, sanctions to achieve disarmament, and currently, arrangements to prevent proliferation of Weapons of Mass Destruction (WMD) by non- state actors. This article analyzes the arms control and disarmament doctrines in light of the UN Charter law and the Practice of its organs.
