THE RIGHT TO A HEALTHY ENVIRONMENT OF THE HUMAN RIGHT

The legal protection of human rights has increasingly become means utilized to achieve the ends of environmantal protection. These rights example the rights to life, association, exression, political participation, personal liberty, equality and legal redress, all contained in international legal instruments, can and have been envoked to further environmental protection. Economic-social rights including the right to health, the right to decent living conditions and right to a decent working environment are also implicated and effectively the motive development the right to environment at the national and international level. At the international level, in the third decade since the stockholm conference 1972, one of the most widely quoted provisions of the final Stockholm Declaration has been principle1. While its formulation stops short of proclaiming a right to environment, it links human rights and environmental protection. It sees human rights as a fundamental goal and environmental protection as an essential mean to achieve the "adequate conditions" for a "life of dignity and well-being" that are guaranteed. At present, no global human rights treaty proclaims a right to environment, altough the Universal Declration of Human Rights and other human rights instruments guarantee a right to an adequate quality of life and a right to health. Among non-binding instrument however, a significant number have included references to environmental rights or a right to an environment of a specified quality.
