Analyzing the most important principle of the commentators and jurists that is based on the infinite rate of dower is the main concern of this essay. Then it comes to this conclusion that in appointing the rate of dower, however, the basis is the mutual consent of spouses but the well - known viewpoint based on the universality and general ac­ceptation of Quran verses especially sura Al - nesa ( v.20 ) in which it is stated that determining the rate of dower in every condition is le­gitimate and determining a maximum for it is illegal, is not accepted because the holy lawgiver in the mentioned verses is not to command that determining the rate of dower , a rate though husband actually and potentially can not afford it but spouses agree with it, is legitimate.
