Review of Dissolving Khobregan House and Parliament by the Leader

The scope of power of governments is one of the main issues in political philosophy and constitutional law. This issue has become significant in Islamic Republic of Iran as an absolute spiritual leadership has been contemplated in the Iranian constitution. As the rule of law indicates that all governmental acts must be based on law, it may be assumed that dissolution of Khobregan House (Expert House) and Parliament by the leader is not possible as they have elected through public voting. In Article 110(8) of the Iranian Constitution, the dissolution of Parliament has been predicated, but there is no provision in the Constitution regarding the dissolution of Khobregan House. This article reviews the principles of Islamic law and constitution law to see whether the Leader could dissolve the institutions elected by public.
