"THE JURISPRUDENCE OF HUMAN RIGHTS COMMITTEE ON PROTECTION OF THE RIGHT TO LIBERTY AND SECURITY OF PERSON"

The right to liberty and security of person, referred to Art.9 of the International Covenant on Civil and Political Rights (1966), which is one of the most significant human rights, has been protected specifically by the Human Rights Committee, as the monitoring body of the Covenant. According to the jurisprudence of the Human Rights Committee, the right to liberty and security of person, contains the right to security of person outside the context of formal deprivation of liberty, which makes it possible to interpret out of the framework of "physical limitations". The right to liberty and security of person include examples such as: the right to be informed of reasons of arrest and charges, and the right to be brought promptly before a judicial authority. These examples has been explicated in detail by the committeeʹs views. This paper would try to offer a better understanding of the concept of liberty and security of person, in the light of the decisions taken by the committee as well as its General Comment No.8
