The Intention of Contracting Parties In Jurisprudential Decree on Contracts in Marriage

One of the controversial problems concerning the effect of conjugal contracting parties in Juris decree on contract is temporary marriage when in the marriage contract tie on distinct time is mentioned, where three viewpoints are offered. Most Imammieyya jurists have observed the changing of this type of marriage into permanent one, while some recent jurists consider this conjugal contract tie invalid. And the third view expresses the detailed affairs between a point where in case of intentional nonmentioned accepted thing, they consider it permanent marrage tie. this paper, seeks to analyze and investigate these views and to come to the conclusion that the famous Imammieyya jurisconsultsʹ view issue a decree of changing this kind of marriage into the permanent one, for which there is no document for defending. So, they order it to be invalid. Finally, the complementary view presented is justifiable regarding the intention of the conjugal contracting parties.
