Dissolution is one of the factors of dissolving marriage tie, and one of its lawful causes is physical disability appearing in each of the couples. The legislator when passing the civic law regulations on defets should allow conjugal dissolution, referring to the Shiʹite Juris to determine the applicable disabitlities fo each man and woman, to establish a system to male the conjugal dissolution possible, especially on the part of husband to be better secured. The present paper seeks to investigate, through analysis, the possibility and development of the problem in our law system while presenting available law Mechanisms to fill the existing gaps. It also tends to observe different types of defects, whether physical or special incureable diseases on each spouse, numerating different points of views of Shiʹite jurists.
