بررسي مباني و مفاهيم حقوق آموزش عالي و تدوين اساسي ترين مسايل آن در ايران

Study of Principles and Concepts of Higher Education law and Preparing of the most Essential Issues in Iran

حقوق آموزش عالي شاخه اي از حقوق آموزش تلقي مي شود. در اين شاخه دو مبحث عمده حق آموزش عالي و حقوق آموزش عالي مطرح است. مبحث نخست زيربناي نظري حقوق آموزش عالي را تشكيل مي دهد و از آن به حقوق بنيادين آموزش نيز تعبير مي شود. در مبحث دوم؛ يعني حقوق آموزش عالي مسيله اصلي تنظيم مناسبات دروني آموزش عالي و همچنين، تنظيم روابط و حقوق متقابل آموزش عالي با دولت، شهروندان و سازمانهاي ديگر مطرح است. در پژوهش حاضر در بخش نظري و مفهومي تلاش شده است تا اين دو حوزه معرفي و مفاهيم اساسي آنها تبيين شود. گام دوم اين پژوهش مسيله شناسي حقوق آموزش عالي در كشور ايران است. در اين گام با اتكا به روش مطالعه اكتشافي مبتني بر مصاحبه نيمه ساختار يافته با مديران و خبرگان آشنا با موضوع، اساسي ترين مسايل و مشكلات موجود بازشناسي شده است. در پايان مجموعه اي از پيشنهادها براي تاسيس و توسعه حقوق آموزش عالي در كشور ايران و ارتقاي كارايي و انسجام آن تدوين و ارايه شده است.

Higher education law is considered as a branch of education law. This branch is posed two major concepts; Higher Education Right and, Higher Education Law. The first concept is encompassed the theoretical foundation of Higher Education Law and is also interpreted as the basics of educational law as well. In the second concept, which is posed Higher Education Law, the main issue is the regulation of higher education’s internal relations and also regulation of higher education relations and mutual rights with government, citizens and other organizations. In this study on theoretical and conceptual sections is at so attempted to explain their essential introduction and concepts. The second step of this study is on problem investigation of higher education law. In this step has been recognized the most fundamental existing problems and issues by an exploration study method based on a semi-structured interview with managers and experts in this field. At the end, has been prepared and posed set of recommendations for establishing and improving the higher education laws in Iran with the approach of boosting effectiveness and solidarity of that will be mentioned.
